. a. The right of all owners of land subject to said <br />easement, ,acting individually or in concert, to close the easement <br />way to all traffic on not more than one day each calendar year or <br />to take such other-reasonable action as may be necessary to pro- <br />tect and enforce the private nature of said easement and to pre- <br />vent any rights therein arising in-favor of the public; and <br />b. The right of each owner of a servient lot to use, <br />enjoy landscape and maintain his land underlying said easement <br />(subject to the obligations to maintain as set forth in paragraph <br />2 hereinbelow) provided he does so in a manner reasonably consistent <br />with the purpose. of said easement, which shall be to free and <br />unobstructed recreational non-motorized passage along the easement <br />way in favor of the Benefitted Property, The easement way is not <br />intended for picnicing, sunbathing, gatherings and parties,. playing <br />of games and other such recreational uses. <br />2. No obstructions to passage shall be maintained or <br />permitted within the easement area of ariy lot. The. easement .area <br />of each Iot and all improvements thereon, including the surfaced <br />pathway originally constructed by Declarants, shall be maintained <br />continuously by the owner of such lot. ~Tithout limiting the <br />generality of the foregoing, the grass and any landscaping on the' <br />easement area of each lot shall be maintained to the~same'standaxds <br />as the remainder of said lot and the surfaced pathway shall be <br />maintained in reasonably good repair and condition suitable for <br />foot and bicycle traffic. Nothing contained in this instrument <br />shall be deemed to require an owner to remove snow or ice~from any <br />portion of the easement area. . <br />-3- <br />
