<br />1 <br /> <br />I <br /> <br />1 <br /> <br />Council Meeting Minutes <br />May 26, 1987 <br /> <br />Brandt commented the city cannot have a project with which it is <br />not satisfied, indicated replacing all of the curbing is neither <br />feasible nor desireable; asked for some kind of assurances that <br />the company will be around to repair or replace things for a sub- <br />stantial period of time, noting it is a 50-year project. <br /> <br />Gunderman indicated the residents deserve a First Class job; would <br />like to see or hear a decision that will be fair and equitable to <br />all. <br /> <br />Benke indicated if we check testing <br />Braun firm to conduct that testing <br />could be a deduct or negotiation off <br />sponded affirmatively. <br /> <br />Weyrauch stated the sounding would test the soundness of the cos- <br />metic repairs. <br /> <br />or sounding, we could ask the <br />and the cost of the testing <br />price of contract; Proper re- <br /> <br />Proper sees no problem to go ahead with the testing and would rec- <br />ommend it. <br /> <br />Jim Horowitz, 703 Fourth Avenue N.W., asked, if the changes are <br />sound, do we still have to pay taxes for damaged goods received; <br />Benke stated, to the extent we can calculate, we would not pay <br />full price for the project; in this case, we will ask for profes- <br />sional assistance for an unbiased review and a recommendation. <br /> <br />Roger Dalzen, 784 Fourth Avenue N.W., stated Midwest just raised <br />the sewer basin in his alley which is now too high for water to <br />drain, and advised there are still two tire tracks in the alley; <br />Benke commented the project was not yet complete. <br /> <br />Blomquist asked if there is a specific procedure the city will use <br />to arrive at an equitable deduction; Sinda stated the city will <br />get an individual consultant to look at the damage and give us a <br />recommendation on what the damage is worth; with that recommenda- <br />tion we will sit down with the contractor and suggest that amount <br />be deducted off the project. Proper stated the meeting with the <br />contractor would take place after the project has been completed <br />(sometime in June). <br /> <br />Because the consultation would be less than $2,000, Sinda will <br />hire a firm to review the damage and make a recommendation. <br /> <br />Benke asked that Braun test the curb and report any problems prior <br />to laying of the asphalt. Benke asked when there would be an in- <br />spection drainage and elevation problems; Proper responded he is <br />in the process of going through the project and preparing prelim- <br />inary punch list, items on which, if not corrected, will have to <br />be redone; all of which would be completed prior to a request for <br />final payment on the project, including deducts and warranty ex- <br />tensions. <br /> <br />Page 5 <br />
