<br />1 <br /> <br />I <br /> <br />1 <br /> <br />Council Meeting Minutes <br />May 26, 1987 <br /> <br />Proper indicated there would be a bond for all of the patching; <br />once the wearing course is on, other things may show up on which <br />we would recommend a deduct; he is reserving judgement on some <br />areas until the final wearing course is on, but felt the project <br />should proceed as the curb is now vulnerable. Proper recommended <br />the city select a consultant to determine an equitable dollar <br />amount for cosmetic damage. <br /> <br />Because he had not been receiving any calls complaining about the <br />project, today Proper talked with people in the project area. <br />Proper found the majority of the residents did not want curbing <br />torn out and replaced, nor did they want the job prolonged; and he <br />explained the durability of the patching when that concern was ex- <br />pressed. Summarizing his review of the projeet area, Proper <br />stated he did not find a high level of dissatisfaction, and most <br />were complimentary of the project and thought it looked very good. <br /> <br />Benke asked if there were things that can be done to reduce the <br />chance of this happening again; from experience Weyrauch stated <br />perhaps closer supervision and a more demanding stature or posi- <br />tion with the contractor may have precluded the damage. <br /> <br />Benke stated ultimately the contractor is responsible to produce a <br />product and is responsible for quality control. <br /> <br />In response to Danny Dahms's, 674 Third Avenue N.W., inquiries, <br />Weyrauch indicated his firm in St. Paul had never done business <br />with New Brighton, he had never worked with Proper, and he had <br />examined 80% of the project; and Proper stated there is no more <br />curbing to be replaced at this time. <br /> <br />In response to Dahms's further inquiry, Benke stated the old curb- <br />ing was not functioning to the level of the service the city <br />wanted and it was a part of the total project. Benke indicated <br />neither council nor staff believe the new curbing is as it should <br />have been, which is why there will be a reserve or an extended <br />warranty for problems that have not be incurred at this point; but <br />stated these problems can occur and the city is doing its best to <br />rectify the situation. <br /> <br />In response to a citizen's inquiry, Weyrauch stated it common <br />practice to use a light metal object along with a visual survey to <br />inspect epoxy repairs. <br /> <br />With regard to a sound test before the final coat, Weyrauch indic- <br />ated it would cost several hundred dollars and would take a few <br />days did not feel it was warranted, but noted it would be <br />council's decision. <br /> <br />In response to Benke's question, the contractor indicated he could <br />do spot checks and would be willing to work with Proper; Weyrauch <br />indicated a sounding is not 100% effective and indicated the real <br />proof is in the durability of the repairs to withstand a freeze! <br />thaw cycle. <br /> <br />Page 4 <br />
