III <br /> <br />I <br /> <br />III <br /> <br />Council Meeting Minutes <br />May 26, 1987 <br /> <br />Gunderman asked why the Planning Commission made the recommenda- <br />tion; Blomquist stated the Planning Commission directed the appli- <br />cant to contact his lender for the option of transferring the <br />land; that request was denied by the mortgage lender; subsequently <br />the Planning Commission approved the request for a variance. <br /> <br />Benke stated the alternatives are to deny the variance, continua- <br />tion, or approve as is. Benke believes the approval process and <br />the whole zoning change process suggests that 60-feet is no longer <br />desirable; would be inclined to go with the wider lot in that par- <br />ticular where other lots are wide. Benke would support continua- <br />tion to pursue other options for consolidating the lots. <br /> <br />Brandt agreed with Benke and disagreed with the Planning Commis- <br />sion's recommendation; does not believe there are sufficient jus- <br />tifiable reasons for granting a variance in this instance and sees <br />no purpose for continuing the matter. <br /> <br />Blomquist did not believe there is any justification to granting a <br />variance, but believes council should allow the applicant one more <br />chance. <br /> <br />Gunderman restated the motion, Blomquist concurred, to DELAY COUN- <br />CIL ACTION IN ORDER TO PROVIDE THE PETITIONER AN OPPORTUNITY TO <br />LOOK AT ALTERNATIVES. <br /> <br />3 Ayes - 1 Naye (Brandt) - Motion Carried <br /> <br />Mattila reviewed staff report and site plans for approval to con- <br />struct an addition onto the existing Perkin's Restaurant; <br />explained city's Sanitarian met with Perkin's representatives and <br />resolved Planning Commission's concerns, but that the condition <br />for adequate food preparation area and additional refrigeration <br />and freezer appliances was not deleted from LP-213 in accordance <br />with the Sanitarian's request to assist him with obtaining the <br />necessary facilities in the kitchen area. <br /> <br />In response to Benke's concern, Mattila stated when the seating <br />area is expanded, the food prep area and freezer space must also <br />be expanded to comply with State Code. <br /> <br />Motion by Gunderman, seconded by Blomquist, to APPROVE LP-213 SUB- <br />JECT TO THE FOLLOWING CONDITIONS: <br /> <br />1. PROVISION OF ADEQUATE FOOD PREPARATION AREA AND ADDITIONAL RE- <br />FRIGERATION AND FREEZER APPLIANCES AS DETERMINED AND APPROVED <br />BY THE CITY SANITARIAN; <br />2. APPROVAL OF A GRADING AND DRAINAGE PLAN BY THE CITY ENGINEER; <br />3. THE APPLICANT EITHER OBTAIN RICE CREEK WATERSHED DISTRICT AP- <br />PROVAL OR PROVIDE CITY STAFF WITH A LETTER FROM THE RCWD STAT- <br />ING NO PERMIT IS REQUIRED; AND <br />4. PROVISION OF A PERFORMANCE BOND EQUAL TO ONE HUNDRED PERCENT <br />OF THE ESTIMATED COST TO RELOCATE OR REPLACE THE EXISTING <br />LANDSCAPING ON THE SOUTHWEST SIDE OF THE BUILDING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Page 8 <br />
