<br />RESOLUTION N0 <br />STATE OF MINNESOTA. <br />STATE OF MINNESOTA <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />-FOR VARIANCE, UN-210 <br />WHEREAS, An application fora variance entitled VN-210 <br />.has been made by Charles Bergman., 299 Oakwood Drive to allow <br />a fence 10 feet in height in the front and side yard of a <br />residential sito. <br />WHEREAS, The procedural history of the application is as <br />follows• <br />1. That an application-for Variance, UN-210 was filed <br />with the City of New B"righton on Ju y 13, 1979. ! <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on August 22; 1979. <br />3. That the City-Council, pursuant to published a`nd <br />mailed notices, held a public hearing on September 11, <br />1979, all persons's present at the hearing were.,given: <br />an opportunity to be heard. - <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br />NOW THEREFORE BE IT RESOLVED, That the -New Brighton City <br />Council makes the following Findings of Fact in respect to <br />VN-210: <br />1. That the applicant has .not obstructed vis-ion by <br />using screening material in the fence; <br />2. That the applicant has maintained the. boulevard; <br />3. That the fence-.has not adverse]y affected traffic <br />flow in that area; <br />4. That the fence provides maximum usage of the existing <br />concrete pad; <br />5. That the fence provides safety to those person's. <br />using the concrete pad; <br />6. That. the fence does not .have a substantial negative <br />impact on adjacent properties. <br />BE IT FURTHER RESOLVED, That the application for <br />VN-210 is hereby approved subject to the following conditions <br />
