November 21, 1979 <br />Supplement To Report #79-505 <br />APPLICATION FOR VARIANCE <br />VN-212, BERGER TRANSFER & STORAGE, INC. <br />PURPOSE <br />To consider a request.'for a variance to install a six foot high <br />chain link fence in a side street yard of an industrial site. <br />BACKGROUND <br />APPLICANT: Berger Transfer & Storage, Inc. <br />LOCATION: Generally west of Old Highway #8, <br />north of 3rd Street S.W., and east <br />of 9th Avenue S.W. <br />EXISTING ZONING: I-2, Heavy Industrial <br />ORDINANCE REGULATION: Section 13-050 f.l.'states that: <br />"Fences erected in the front yard or <br />ona street side yard shall not exceed <br />three and one-half (32) feet in height <br />and shall have at least seventy-five <br />(75) percent of their vertical surface <br />plane open when viewed from a point <br />perpendicular to that plane." <br />Berger Transfer and Storage, Inc. is requesting the 6 foot high <br />fence-for security reasons. The unique circumstance indicated by <br />the applicant is that the site is enclosed on all sides by. <br />public street. Therefore, a stri-ct implementation of the ordinance <br />would only allow the applicant a 32 foot high fence which provides <br />no security for the applicant's property. The ensuing hardship <br />would therefore be the lack of security which otherindustrial <br />sites are afforded. <br />In regard to the affect of granting this variance on surrounding ter' <br />properties, the fence is situated approximately thirty (30) feet <br />from the property line and will be on the inside of'the-proposed <br />berm. The berm will reduce, the visual impact of this extensive <br />amount of fencing. The fence is an opaque chain link fence and <br />also because of its setback will not cause any problems in terms <br />of visual impairment for vehicles traveling on any of the <br />surrounding public streets. <br />Staff has recommended a minor change in the location of the fence, <br />as denoted by the red line on the site plan. This adjustment <br />moves the fence back away from the public right-of-way. <br />r
