November 21, 1979 Supplement To Report #79-505 APPLICATION FOR VARIANCE VN-212, BERGER TRANSFER & STORAGE, INC. PURPOSE To consider a request.'for a variance to install a six foot high chain link fence in a side street yard of an industrial site. BACKGROUND APPLICANT: Berger Transfer & Storage, Inc. LOCATION: Generally west of Old Highway #8, north of 3rd Street S.W., and east of 9th Avenue S.W. EXISTING ZONING: I-2, Heavy Industrial ORDINANCE REGULATION: Section 13-050 f.l.'states that: "Fences erected in the front yard or ona street side yard shall not exceed three and one-half (32) feet in height and shall have at least seventy-five (75) percent of their vertical surface plane open when viewed from a point perpendicular to that plane." Berger Transfer and Storage, Inc. is requesting the 6 foot high fence-for security reasons. The unique circumstance indicated by the applicant is that the site is enclosed on all sides by. public street. Therefore, a stri-ct implementation of the ordinance would only allow the applicant a 32 foot high fence which provides no security for the applicant's property. The ensuing hardship would therefore be the lack of security which otherindustrial sites are afforded. In regard to the affect of granting this variance on surrounding ter' properties, the fence is situated approximately thirty (30) feet from the property line and will be on the inside of'the-proposed berm. The berm will reduce, the visual impact of this extensive amount of fencing. The fence is an opaque chain link fence and also because of its setback will not cause any problems in terms of visual impairment for vehicles traveling on any of the surrounding public streets. Staff has recommended a minor change in the location of the fence, as denoted by the red line on the site plan. This adjustment moves the fence back away from the public right-of-way. r
