<br /> <br />RESOLUTION NO <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR VARIANCE, VN-212 <br />WHEREAS, An application for a variance entitled VN-212 <br />has been made by Berger Transfer & Storage, Inc., to permit <br />the installation of a 6 foot high fence in a side street <br />yard of an industrial site; and <br />WHEREAS, The procedural, history of the application is <br />as follows: <br />1.' That an application for Variance, VN-212 was filed <br />with the City of New Brighton on October 1, 1979. <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review on <br />November 20, 1979. <br />3. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on October 23, <br />1979 and continued on November 27, 1979, all <br />person's present at the hearing.were given an <br />.opportunity to be heard. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton <br />City Council makes the following Findings of Fact in respect <br />to VN-212: <br />1. That the site is located in a I-2, Heavy Industrial <br />zoning district. <br />2. That the site is unique in that it is enclosed on all <br />. sides by public street. <br />3. That a six foot fence is necessary for security and <br />a hardship would result if the zoning code was <br />literally enforced only allowing the applicant a <br />fence of 32 feet in height. <br />3. That the fence is an opaque chain link fence which <br />will not impair the visibility of persons traveling <br />on adjacent public streets. <br />4. That the proposed fence will be setback on the inside <br />of the berm and landscaping and therefore will not <br />create an appearance that would adversely affect <br />adjacent property owners and would.be consistent <br />with similar security fences in that area.
