<br />1 <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 12, 1987 <br /> <br />Brandt reported Dalzen contacted her three weeks ago with his <br />concerns; since that time she has seen the damage and the problems <br />and understands his outrage, which has been transferred to <br />council; agrees council is not in a position to determine what <br />needs to be done at this time, but believes it should give staff <br />and the contractor a strong message it will not accept shabby work <br />anywhere in New Brighton. <br /> <br />Blomquist asked if the issues of testing and inspections were in <br />the specifications; Proper responded the city tests the concrete <br />for strength and the city's inspectors were present as often as <br />possible. <br /> <br />Benke indicated the general provision and the underlying assump- <br />tion is work will be done in a workmanlike professional manner and <br />within the industry standards. Benke further noted within the <br />industry there are people who do good work and those that don't <br />and, from what was presented tonight, the curb went in properly <br />but those coming after to lay the asphalt chipped the curb with <br />the heavy equipment. The evidence suggests the product is not <br />acceptable and we need to find a solution. <br /> <br />Motion by Gunderman, seconded by Williams, to SUSPEND ANY FURTHER <br />PAYMENT AND DIRECT STAFF TO RECOMMEND ALTERNATIVES AT THE MAY 26, <br />1987, COUNCIL MEETING. <br /> <br />Proper indicated the project would be almost completed by that <br />time; much of the repair work will be done this week, the sodding <br />will be completed by the end of the week, and by next week the <br />final wearing course will be applied. <br /> <br />Benke stated we need to perhaps extend the period of the contract <br />to get the work done. <br /> <br />Proper reviewed the options available and ruled out the removal <br />and replacement of curbing with dings along the front, except <br />where cracked or where the surface is very badly torn up, because <br />the process of jackhammering out the curb and hand-forming a new <br />curbing will result in the loss of a rock bond and sheer <br />resistance and is subject to differential settlement. Proper <br />further explained the city annually replaces curbing which has <br />settled and is, therefore, deemed hazardous and a liability to the <br />city. Proper continued that replaced curbing always stands out <br />and it never looks the same. Although some damage will happen in <br />any project, Proper was upset about the recklessness associated <br />with the extent of damage on this project, but doesn't believe the <br />over-300 people in this project would want to have the curbing <br />replaced. <br /> <br />Proper indicated the curbing repair is being done with a proven <br />epoxy material which is probably more durable than the curbing <br />itself (it has been used on a project that is approximately five <br />years old and there is no evidence of deterioration), and indi- <br />cated it will become the same color when the curbing is slightly <br />soiled and will be virtually unnoticeable. <br /> <br />Page 5 <br />
