Felty <br />indicated he has a long punch list and those items are currently <br />being corrected; felt his company tried to do a quality installa- <br />tion and regrets the way the project was left over the winter. <br /> <br />With regard to a resident's questions regarding dry and dead sod, <br />Felty indicated the sod company is aware they will have to replace <br />some sod. <br /> <br />Benke stated before the city makes final payment the problems will <br />have to be addressed to the satisfaction of the city; Proper will <br />make the determination whether or not a patch is acceptable, or if <br />a deduct is warranted in terms of compensation for a lesser quali- <br />ty. <br /> <br />Gunderman thanked Dalzen for doing a good job in preparing a pre- <br />sentation of what many people have experienced and, as a council <br />and as a community, Gunderman feels the city needs to "bite the <br />bullet" because to cut-and-paste is penny-wise and pound-foolish. <br /> <br />Gunderman believed the curb was put in appropriately but was des- <br />troyed when the street and sod were installed, which is heart- <br />breaking because people make a great effort to keep their yards in <br />good shape; and would like council to take action to make this a <br />test case for the City to see that it is done correctly. <br /> <br />Williams explained he had not been able to review the project as <br />he had been out of town so he also appreciated the presentation <br />was very objective and show real damage. Williams continued the <br />city should never accept shoddy work, particularly in residential <br />areas where it is more noticeable and where there is a feeling of <br />ownership. <br /> <br />Williams questioned whether or not the edge of the gutter will be <br />absolutely straight and even as a result of patching, noting an <br />asphalt line following every nick would not be very attractive, <br />and added he would have a hard time approving the job if it were <br />not straight. If it is not possible to patch with that quality, <br />Williams feels it ought to be replaced; if it is going to be <br />patched, asked if it were possible for the contractor to put up a <br />bond for a period of time so the residents know if anything goes <br />wrong with the patching job there will be money in the bank to pay <br />for a redo. <br /> <br />Benke stated that is one of our options (to review what can be <br />fixed and what cannot). <br /> <br />Gunderman stated his major concern is that we do not let this pro- <br />ject slide through; City Engineer needs to have some bite and be <br />listened to by the contractor. <br /> <br />Benke, not being sure council heard all of the options, would like <br />to give the issue to staff for advisement and a report to council <br />with a recommendation. <br /> <br />Page 4 <br />
