As
there were no questions from the audience or council, Gunderman
moved, seconded by Williams, to CLOSE THE PUBLIC HEARING.

5 Ayes - 0 Nayes, Motion Carried

Motion by Brandt, seconded by Gunderman, to WAIVE THE READING AND
ADOPT A RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITH-
IN THE CITY OF NEW BRIGHTON (Blanski).

5 Ayes - 0 Nayes, Motion Carried

As no one was present to ask questions or comment on certification
of service fees (which had been continued from a previous Council
Meeting) and because certification was no longer necessary,
Gunderman moved, seconded by Blomquist, to CLOSE THE PUBLIC HEAR-
ING.

5 Ayes - 0 Nayes, Motion Carried

Council Business
Locke lndlcated he, Nelson, and Bishop met with Mark Beisswenger;
as Beisswenger is looking at new space for the hardware store,
they met to find some means .of addressing the code violati~ns in
the existing building on an interim basis.

Locke further indicated at this time Beisswenger has not communi-
cated what he will do and we have not been able to develop plans
to handle the violations in the building; staff is recommending
the orders that have not code been accomplished be restated with
new time-lines.

In response to Williams's question, Beisswenger indicated Dave
Parkhill, partner of Brighton Oaks Shopping Center, has no formal
plans; there are complications with downtown that have to be ap-
proached before they can be resolved; trying to see what the city
can do for him with regard to his property; wants to take a look
at downtown before deciding whether or not to build on his proper-
ty.

Locke indicated by June 1, 1987, Parkhill needs to have leases for
a given amount of space so financing documents can be prepared;
Parkhill has 90 days to have financing, Letter of Credit, and
original terms of the Development Agreement in order. At this
time Parkhill has only conceptual plans, by necessity, but he has
drafted a proposed letter for Mark Beisswenger which Beisswenger
has under review.

Assuming the downtown project is to proceed and Beisswenger will
lease s~ace there, Benke stated we are still twelve months away
from the facility moving into the shopping center and asked how
much wasted effort the would be if the orders are approvedt be-
cause something has to be done regardless of the outcome.

Page 8

Public Hearing

Minor Subdivision
Blanski
Report 87-129
Resolution 87-53
8:50-8:51pm

Certification
of Service
Charges
Report 87-130
8:51-8:52pm

Council Business
Code Vlolatlon
Appeal:
Beisswenger
Hardware
Report 87-131
