- RESOLUTION NO 2302 <br />;; <br />STATE OF h1IPJNESOTA <br />'~ COUNTY OF RA~4SEY <br />~ CITY OF NE4J BRIGHTON <br />!~ RESOLUTION P-IAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />i FOR A PRELIMINARY PLANNED RESIDENTIAL DEVELOPh1ENT, PRD X30 <br />~~ AND A PRELIMINARY PLAT, PL=121. <br />~~ <br />;~ <br />l- WHEREAS, The procedural history of the application is <br />'' <br />~; as follows: <br />~i 1. That an application for a preliminary Planned <br />j Residential Development, PRD #30 and a preliminary <br />! plat, PL-121 was filed with the City of New <br />Brighton on November 13, 1979. <br />~ 2. That such application was reviewed by the New <br />~ Brighton Planning Commission Board of Review <br />on November 20, 1979, December 17, 1979 and <br />January l5, 198U.. In addition, the Park Board <br />reviewed the application on December 6, 1979 <br />and February b, 1980. <br />3. That the City Council, pursuant to published <br />and mailed notices, held a public hearing on <br />February 12,:1980 and February: 27, 1980, all <br />person's present at the hearings-were given an <br />opportunity. to be heard. <br />4. The written comments .and analysis of the City <br />staff, the Planning Commission minutes and <br />recommendations, the Park Board minutes and <br />~ recommendations were considered. <br />N041 THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />PRD X30 and PL-121: <br />1. That the proposed development is consistent with <br />the proposed. Comprehensive Plan; <br />2. That the proposed development would not be <br />detrimental to public health, safety, morals <br />and general welfare of the surrounding area; <br />and <br />3. That the proposal is consistent with the stated <br />purposes of the PRO ordinance as it makes the <br />most efficient use of the land and open space. <br />BE IT FURTHER RESOLVED, That the application for the <br />p:eli~~~inary PRD X30 and preliminary plat PL-121 is and hereby <br />approved subject to_the following conditions: <br />1. That all grading, drainage and utilities be <br />subject to approval of the City Engineer and <br />Rice Creek Watershed District; <br />2. That all fire and emergency lanes, sprinkling <br />connections, and emergency access shall be <br />subject to the approval of the fire department; <br />3. That the applicant dedicate the park property <br />to the City in the form of a deed. That in <br />]ieu of a deed transfer of the property that <br />appropriate legal agreements be concluded <br />between the City and `applicant regarding <br />use of the park facilities and property.; <br />
