,~ <br />UN-214 <br />Page #2 <br />The zoning code does not contain a provision for public park <br />dedication so the only other alternative without reducing the <br />number of units is the application for a variance. It seems <br />that there is some merit for consideration of the variance <br />because this is certainly a unique circumstance. The variance <br />appears to be totally consistent with the stated purposes of <br />the PRD ordinance because it will promote the efficient use of <br />the land and would promote public health and welfare. <br />PLANNING COr•1h1ISSI0N CONSIDERATION AND RECOh1r~lENDATION <br />Sta-ff reviewed their report noting that the variance was necessary <br />since the density permitted on the property retained by the <br />applicant is less than permitted by the P.R.D. recently con- <br />sidered: Staff noted that this application allows for the <br />applicant to deed the park property to the City. <br />Mr. Dave Swenson, area resident, was present, and questioned if <br />the number of units allowed on the site had changed. <br />Chairman Leverkuhn stated there were no changes to the density <br />previously discussed. <br />• Motion by Leverkuhn, seconded by Williams to amend the staff <br />recommended resolution in the following manner: <br />1. That a #4 be added to the procedural history to <br />read: "That the P.R.D, proposal being considered <br />shows a dedication of 4.93 acres for-park land." <br />2. That #2 under NOW THEREFORE BE IT RESOLVED be <br />amended to read: <br />"That the Development site is 4.05 acres." <br />3. That #3 under NOW THEREFORE BE IT RESOLVED be <br />amended by substituting."development" for "total" <br />and changing "48" to "22" <br />4. That #4 under NOW THEREFORE BE IT RESOLVED be <br />amended by deleting the words "consistent and". <br />Vote on amendments, 5 Ayes - 0 rlayes, Motion Carried <br />Motion by Williams, seconded by Lang to waive the reading and <br />adopt the amended RESOLUTION MAKIrdG FINDINGS OF FACT AND <br />RECOMh1ENDING APPROVAL OF APPLICATION FOR VARIANCE, UN-214. <br />_ _ 5 Ayes - 0 Nayes, Motion Carried <br />• <br />
