Report '#80- 161 <br />September 18, 1980 <br />v ?a <br />APPLICATION FOR VARIANCE AND BUILDING PERMIT ` <br />VN-215, LP-105 BELAIR CORPORATION <br />PURPOSE <br />To consider a request for a building permit and variance to <br />construct an industrial building with a 5-foot side yard setback. <br />BACKGROUND <br />APPLICANT: Belair Builders <br />LOCATION: 'Generally east of Old Highway #8" <br />and south of RMS. <br />ZONING: I-1 Light Industrial <br />AREA OF SITE: 28396 Square Feet <br />AREA OF PROPOSED BUILDING: 4,000 Square Feet <br />FLOOR-AREA-RATIO: .14 - <br />EXIST,ING USE: Type II Non-conforming Single <br />Family Home. The house will be <br />destroyed. <br />PROPOSED USE: Belair plans to lease the building <br />to a firm which repairs. small <br />appliances. <br />VARIANCE REQUEST: 5' side yard setback, 15 feet is <br />• required. Overhead door in <br />front yard is,only.40' from right- <br />of-way. 50' is required. <br />COMMENTS: <br />1. Side yard setback is warranted based on shape of the lot. <br />2. Building should be moved back 10.' or the overhead door <br />in front.yard should be removed. <br />3. The Certificate of Survey depicts a slough on the western <br />portion of the site. Preliminary discussions with the <br />Rice Creek Watershed District indicate that the applicant <br />will have to move the proposed building to the east. The <br />applicant will report this change at the Council meeting <br />on the 23rd of September. The Planning Commission in <br />considering the request was made aware of the possible.` <br />change and voices no opposition.
