Report '#80- 161 September 18, 1980 v ?a APPLICATION FOR VARIANCE AND BUILDING PERMIT ` VN-215, LP-105 BELAIR CORPORATION PURPOSE To consider a request for a building permit and variance to construct an industrial building with a 5-foot side yard setback. BACKGROUND APPLICANT: Belair Builders LOCATION: 'Generally east of Old Highway #8" and south of RMS. ZONING: I-1 Light Industrial AREA OF SITE: 28396 Square Feet AREA OF PROPOSED BUILDING: 4,000 Square Feet FLOOR-AREA-RATIO: .14 - EXIST,ING USE: Type II Non-conforming Single Family Home. The house will be destroyed. PROPOSED USE: Belair plans to lease the building to a firm which repairs. small appliances. VARIANCE REQUEST: 5' side yard setback, 15 feet is • required. Overhead door in front yard is,only.40' from right- of-way. 50' is required. COMMENTS: 1. Side yard setback is warranted based on shape of the lot. 2. Building should be moved back 10.' or the overhead door in front.yard should be removed. 3. The Certificate of Survey depicts a slough on the western portion of the site. Preliminary discussions with the Rice Creek Watershed District indicate that the applicant will have to move the proposed building to the east. The applicant will report this change at the Council meeting on the 23rd of September. The Planning Commission in considering the request was made aware of the possible.` change and voices no opposition. The moving of the building will not result in any zoning code deviations, it would just result in a larger front yard.
