VN-215, LP-105 <br />Page #2 <br />V <br />September with Watershed District. The Slough on the property <br />poses the problem and if Belair is not allowed to alter it by <br />moving it farther to the west the building will have to be <br />moved to the east. The applicant noted that this would result <br />in having to extend the driveway, concrete curbing, landscaping, <br />and utilities which makes the proposal more costly. The moving <br />of the building to the east and how far has not yet been <br />determined but the applicant stated that all the dimensions <br />and setbacks (except front yard) would remain as drawn on the <br />plans. <br />Commissioner Livingston questioned whether or not Belair would <br />lease the building. <br />The applicant stated that the building would be owned by Belair <br />and leased to a tenant that repairs small appliances. The floor <br />drains allow an easy method for the cleaning of parts. <br />Motion by Livingston, second by Sande to recommend approval of <br />LP-105 contingent on the following conditions: <br />1. That final drainage and grading plans be approved <br />by the Rice Creek Watershed District; <br />2. That the landscaping plan be revised to provide the <br />type, number and size of existing plantings and <br />proposed plantings to provide screening; <br />3. That the proposed building be setback a minimum of <br />50 feet from the front property line and if the <br />Rice Creek Watershed District requires the building <br />to be moved farther to the east that the administrative <br />authority approve revised site plans to assure compliance <br />with LP-108 and VN-215; and <br />4. That the applicant provide the required concrete curbing <br />along the entire driveway to the front building line. <br />5 Ayes 0 Nayes, Motion Carried <br />Motion by Livingston, second by Sande to recommend approval of <br />VN-215 by adopting a resolution with the following conditions <br />1. That scrubs or other types of landscaping be installed <br />along the 5 foot side yard to accent the building and <br />break up the appearance of the building. <br />2. That there be no outside storage of parts, debris and <br />that all vehicles are currently licensed and operable. <br />3. That the building be setback a minimum of fifty feet <br />from the street right-of-way. <br />5 Ayes - 0 Nayes, Motion Carried <br />STAFF RECOMMENDATION <br />Staff recommends that the Council approve VN-215 by waiving the <br />reading and adopting the attached resolution. <br />Staff.further recommends that the Council approve LP-108 by <br />simple motion contingent on the following conditions:
