<br /> <br /> <br />RESOLUTION N0. <br />NEW BRIGHTON PLAPJNING COMMISSION <br />BOARD OF REVIEW <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL Of <br />VARIANCE APPLICATION UN-205 <br />WHEREAS, an application for a Variance VN-205 has been made <br />by Getty Refi-Wing and Marketing Company to allow the installation <br />of ground signs, 46 square feet in area in a B-1, Limited <br />Business District.. <br />WHEREAS, the procedura] history of the application is as <br />follows: <br />1. That an application for a Variance VN-205 was filed <br />with the City on May 7, 1979. <br />2. That-the Board of Review heard and reviewed the <br />application at its regular meeting on May 15, 1.97.9. <br />3. The written comments and analysis of the City Planner <br />and all person's statements made at the Board of Review <br />meeting were considered. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that <br />the following Findings of fact are made in respect to VN-205. <br />1. That the general purpose of the sign ordinance is to <br />promote sound identification, reduction of clutter and <br />aesthetic enhancement. <br />2. That-the two proposed ground signs would meet all code <br />requirements except area. <br />3. -That the .proposed ground signs are compatiable with <br />.surrounding properties. and provide sound identification, <br />4. .That the practical difficulty is that the company's <br />standard sign is 46 square feet and the unnecessary <br />hardship is that the applicant would be required to <br />have to get a custom made sign to meet ordinance- <br />regulations. <br />5. That the property is located in a B-1 zone and the <br />proposed Comprehensive Plan designates the area for <br />' General Business and if the parcel was in a B-3 zone- <br />the variance-would not be needed. <br />BE IT FURTHER RESOLVED, that the application UN-205 is <br />hereby approved subject to the following conditions: <br />1. That the ground signs contain tenant name and/or logo <br />on1Y, <br />2. That such ground signs shall not exceed 46 square feet <br />in area nor 20 feet in height, and~shadl have a <br />minimum setback. of 10 feet from County Road E and <br />Silver Lake Road. <br />Adopted this day of 1979. <br />Richard Brown, Chadrman <br />Joan M.
