The developer desires. getting. <br />the utilities installed this year but the City would not have <br />enough time at this late date. City policy. has been not to <br />a71ow developers to install their own public utilities. <br />Installation of utilities is needed only for the units adjacent <br />to the proposed cul-de-sacs. All remaining units can be <br />serviced by existing utilities in adjacent streets. <br />D. Park <br />------ --- -- The preliminary plan 'proposes an area. of approximately- 4:8 <br />acres (Outlot "A") to be dedicated to the City for a neighborhood <br />park.. Such dedication would-occur at the time of platting.. A <br />good feature, from the City's view point is that title to the <br />park-could be received prior to any building permits being <br />issued. As noted above the dedication of -land for a public park <br />causes a problem in-terms of the potential unit density.- The <br />current PRD Qrdinance has no provision, nor incentive, for <br />donating/dedicating Land to the City for a public-purpose. As <br />a result the applicant is proposing to dedicate land to the City <br />and has also filed an application for a variance to permit a <br />higher-density in the acres remaining after deleting the public <br />streets and park. In-short, th.e applicants are seeking a trade- <br />off for their park dedication. <br />Acquisition of a park in this area is not limited to the applicant's <br />.proposed dedication. Tfie property could also be,acquired by: <br />1. Negotiated Purchase <br />2. Condemnation <br />3. Acceptance of a Permanent Park Easement <br />Alternatives l and 2 both require City funds. Alternative 3 would <br />leave free title to the property to the applicant while the City <br />would hold a perpetual easement. The City Attorney previously <br />discouraged, but did not rule out, this alternative. <br />Several questions regarding the proposed park were raised at the <br />Planning Commission meetings: <br />1. Facilities Within The Park - no facilities are proposed <br />at present. It has been normal procedure for the Park <br />Board to work with area residents to determine how the <br />park is to be developed. <br />2. Parking - There are no parking spaces- proposed exclusivehy <br />for the park. There are spaces availabTe_,just east. of <br />the park on the shopping center property.. Park staff <br />has indicated previously that they strongly encourage. <br />residents to walk to neighborhood parks and. that the <br />presence of parking spaces. may. encourage use of the <br />park by persons outside of the neighborhood. <br />
