` ' ' -2-

5. Shopping Center Addition - The Council approval
required that you upgrade the driveway off of
Rice Creek'Road and you were granted an extension
to June 1, 1982 because of Super Valu plans for
construction. There have been no formal applica-
tions for construction on this property and your
extension has expired. I have received three
complaints this Spring concerning the condition
of this driveway. There are two options available
to you at this time:
A). Upgrade the driveway as required and specified
by the Council starting work before July 15,
1982 and completing said work by August 31,
1982 or
B). Completely closing off the driveway if there is
an application for a building permit by July 15,
1982. The council action was based on traffic
safety and something must be done because of its
condition.
6. Park Place. The park is scheduled for development
this year.and you are required to have the fill removed
from this property. Staff is requesting that you con-
tact Les Proper, City Engineer before July 15, 1982 to
give him the schedule you have for removing said fill.
Also, as a reminder, a permit is required for the ex-
traction of materials of more than 100 cubic yards.
These notifications serve as a schedule to resolve a number of
concerns over development agreements you have made and provides
an orderly approach to their resolution. I appreciate your
continued cooperation with these items.
Sincerely,
1
oan Archer,
City Planner
