Archer, City Planne <br />SUBJECT: Grading Plan `Mead ow Wood Park <br />It is my understanding that there are two possibly alternatives to <br />the previously approved grading plan for the park. <br />First, Mr. Ernst proposed that the configuration of the pond be changed <br />so that it is deeper almost entirely on originally park property (see <br />attached sketch). The ponding would then be removed from the property <br />which was originally designed as a 4 unit lot. During the review of <br />PRD-27 grading and drainage plan the Park Board, Planning Commission <br />and Council stated that the ponding for the development should not <br />take place entirely on park property. Because of the requirement the <br />developer share in the ponding requirement, Mr. Ernst deeded the four <br />unit lot to the City of New Brighton for park property and ponding. <br />Mr. Ernst requested at that time that two of those units be put into. <br />the condominium project and the other two into the northern 4 unit lot. <br />The Council has since that time approved the final plans for the <br />condominium building with the two additional units. Mr. Nasim M. Qureshi, <br />City Manager of Fridley is now the owner of that condominium site and <br />has been assured by staff that the Council approval included the two <br />additional units. <br />The northern 4 unit lot is now owned by William Barbush. He has <br />obtained approval by the Planning Commission for a 6 units building on <br />that property. <br />If it is Mr. Ernst's intention of developing the original southerly 4 <br />plex lot he could only do so by amending the original PRD-27 to obtain <br />more units than previously approved. Because he is not the owner of <br />the northern 4 plex lot nor the condominium site he cannot reduce the <br />number of units on those properties. <br />In summary, I would like to list my concerns over the alternative of <br />changing the configuration of the pond: <br />1. The only reason I can see for changing the pond would be to <br />provide a buildable area on that original 4 plex lot; <br />2. The City of New Brighton owns the property as park property - <br />the City Attorney would have to be consulted on how the City <br />would/could dispose of this property; <br />3. Mr. Ernst does not own the southern 4 plex property nor the <br />northern property or condominium site;
