APPLICATION FOR VARIANCE
VN-.222 McCALLUM
PURPOSE
To consider a request for a minor subdivision creating five (5)
lots, 1 lot with less than the required width.
BACKGROUND
APPLICANT: Lois McCallum
LOCATION: 1440 West County Road "D"
Generally located south of 7th
Street SW, north of County Road.
"D", west of McCallum Drive,
and east of Continental Drive.
EXISTING ZONING: R-1, Single Family Residential
PRESENT USE OF PROPERTY: Single Family Residence
PROPOSED USE OF PROPERTY: Five (5) Single Family Lots-
CODE REQUIREMENTS: Section 26-24 of the New Brighton
Subdivision Ordinance provides for
the subdivision of property without
platting on the basis of smallness
in size and a well-defined area.
The zoning code requires single
family lots to be 75 feet in width
at the buil-.ding setback and ]0,000
square feet in area.
APPLICANT'S PROPOSAL The applicant is proposing the
minor subdivision to subdivide a
single family lot into five (5~
single family lots.
The applicant is requesting a
variance on the basis that the one
(T), lot on County Road "0" has a
width of 72 feet rather than the
required 75 feet. The applicant
has noted that the rationale for
the variance is that there is an
existing house on-the property which
precludes the subdivision of the
proposed lots on County Road "D"
into lots with 75 feet in width.
The hardship as indicated by the
applicant would be the result of
two (2) lots excessive in size
rather than the three (3) as
proposed. In addit-ion, the
applicant states that the situation
is somewhat unique by the fact that..
the property contains an existing.
single family home.
