T <br />• <br />RESOLUTION NO <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />. CITY OF NEW BRIGHTON, <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />,FOR `VARIANCE, VN-223 <br />WHEREAS, an application for a variance entitled VN-223 <br />has been made by RCE Corporation to permit the construction of <br />a condominium building with less than the required side yard <br />setback under a PRD; and <br />WHEREAS, the procedural history of the application is as <br />follows <br />1. That an application for variance, VN-223 was filed <br />with the City of New Brighton on August 11, 1981. <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review on <br />August 18, 1981 9 <br />3. That the City Council, pursuant to published and <br />i mailed notices held a-public hearing on September 8, # <br />1981 and September 22, 1981, all person's present <br />at the hearing were given an opportunity to be heard. F <br />4. The written comments and analysis of the City staff, " <br />the Planning Commission minutes and recommendations s <br />were considered. <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City s <br />Council makes.th.e-following Findings of Fact in respect to <br />VN-223: <br />1. That under PRD #27 th.e applicant dedicated 5 <br />acres of land to the City of New Brighton <br />for parks <br />2. That the Rice Creek Watershed District required <br />an amended storm water drainage plan which t <br />reduced the size of the condominium property; <br />3. That the building size; shape and donfiguration <br />on the prope.rty is unique in that such a Y- <br />shaped building only encroaches on the setback_ <br />lines at the two corners; 4 <br />i 4. That there are existing R-2, Two Family, <br />Residential Developments to the west of the ! <br />proposed building and that more than a five <br />` (5) foot setback should be required on the <br />western portion of th.e condominium site; i <br />5. That the Fire Department requires and recommends <br />that the applicant provide at least 15 feet <br />on each side of the building for emergency <br />access;
