This modification in concept appears to be <br /> acceptable. The Council :. Resolution 2233 approving <br /> VN-206`.-had a finding that reads <br /> "That due to the close proximity of the park to <br /> the condominium building it is advisable and <br /> appropriate that the condominium parking area be <br /> located on thesouth side of thecondominium <br /> building and therefore it is appropriate to permit <br /> front yard parking in a residential district." <br /> -.The proposal only includes the provision for the two <br /> (2) required handicap parking spaces at 12' x 20' <br /> and three are required. <br /> - The design with the step-up curb to building;eli:minates <br /> the requirement for a handicap accessible building. <br /> - Another modification to the zoning code resulting from <br /> this proposal is that off-street parking of 4 or more <br /> vehicles be screened from adjacent public right-of-ways. - <br /> The proposed two foot berm and 5 Russian Olive trees do <br /> not and will not adequately screen the parking area. <br /> 8. "That a Homeowners Association to cover maintenance of <br /> building and grounds for the condominiums, duplexes, and <br /> townhouse/4-plexes be established." <br /> - The Homeowner's Association documents for the condominium <br /> will be reviewed by the City Attorney at the time of <br /> platting. <br /> 9. "That particular attention in regard to landscaping and <br /> buffering be given to the condominium parking area north <br /> of Rice Creek Road, the area adjacent to the shopping center <br /> and the property adjacent to the existing single family homes <br /> on the east side of 29th Avenue N.W." <br /> - As staff previously stated the proposed landscape plan <br /> does not provide an adequate buffer of the parking. The <br /> "Russian Olives" should be replaced with a evergreen hedge <br /> or collection of trees and shrubs. The landscape area <br /> is 15 feet wide and the plantings should be placed on <br /> the applicant's property not the street right-of-way. <br /> Additional plantings are necessary on the east side of the <br /> site to break up the appearance/bulk of the four story <br /> building and to screen the parking lot. A fence is required <br /> around the pool and such.fence shall be depicted on the <br /> plans for location, height and material of construction.
