STAFF COMMENTS <br />CONFORMANCE WITH PAST COUNCIL ACTION, PRD #27, RESOLUTION #2226 <br />See Att <br />n <br /> ac me <br />t <br />Conditions relating to'condominium building': <br />1. "That all grading,' drainage,` street and utilities be subject <br /> to approval of the City `Engineer." <br /> - The applicant has approved plans by the Rice Creek Water- <br /> shed District. <br />2. "That all fire hydrant locations, fire and emergency lanes, <br /> sprinkling connections, emergency access ladders, etc., <br /> shall be subject to the approval of'the Fire Department." <br /> This conditionstill remains unresolved and will not be <br /> totally addressed until the mechanics for the building <br /> are designed. The reason for the variance request is in <br /> part a response by the applicant to provide 15 feet on <br /> both sides of the building for emergency access. The <br /> method of obtaining that access all year round has not <br /> been resolved. The present design only provides access <br /> .to one side of this 4 story residential building. Such <br /> access is not acceptable to the Fire Department. This <br /> it-P,m should still remain a condition and be resolved <br /> prior to any issuance of a building permit. <br />3. "The condominium building shall be built for individual unit <br /> ownership, be of masonary construction, having underground <br /> parking, and have a Fire Department approved sprinkling <br /> system." <br /> - Since complete building plans have not been provided, staff <br /> cannot determine that any of the above items are provided <br /> with the exception of underground parking. <br />4. "That the final plans for the 4-story condominium building <br /> shall show the final plat for division of the building into <br /> separate units." <br /> - Similar to past condominium projects the platting process <br /> for each unit takes place with the construction of the <br /> units. A more enforceable condition should be "that the <br /> certificate of occupancy not be issued until a copy of the <br /> necessary recordable document of ownerships is filed with <br /> the City Building Official." <br />5. "That the applicant provide an agreement providing for over- <br /> flow condominium parking on the shopping center parking lot <br /> or;-fdditional parking on the condominium site as needed." <br /> - Flue applicant has not presented any such parking agreement.
