"That the applicant provide an agreement providing for overflow <br />condominium parking on the shopping center parking lot or <br />additional parking on the condominium site as needed." <br />-The applicant has not presented any such parking agreement. <br />-In regard to providing additional parking on the condominium <br />site, the applicant is proposing a modification in the parking <br />requirements. The zoning code requires 2 parking spaces <br />per unit and that at least one be enclosed. There are 58 units <br />proposed requiring 116 parking spaces and the applicant is only <br />providing 115 spaces. <br />-In addition, another modification requested is parking within <br />the front yard of a residential development. Parking lots are <br />only allowed in the side and rear yards. <br />-This modification in concept appears to be acceptable. The <br />Council Resolution 2233 approving VN-206 had a finding that <br />reads: <br />"That due to the close proximity of the park to the <br />condominium building it-is advisable and appropriate <br />that the condominium parking area be located on the <br />south side of the condominium building and therefore <br />it is appropriate to permit front yard parking in a <br />residential district." <br />It is the design of the parking that is questionable. The <br />design leads to another modification to the zoning code, - <br />parking within 15 feet of a street right-of-way. The <br />proposed parking lot begins within 10 feet of the..-front <br />property line.' <br />-Another modification requested is to design parking spaces <br />only 19 feet in depth; the code requires 20 feet. Since the <br />driving lanes are designed at 24 feet and the new.code <br />allows 22 feet the extra foot for the parking spaces can be <br />obtained. <br />-The proposal also does not include the provision for the <br />three (3) required handicap parking spaces at 12' x 20' and <br />signed. <br />-The design with the step-up curb to building eliminates the <br />requirement for a handicap accessible building. <br />-The design of the parking lot also places parking spaces <br />in front of the main entrance and eliminates the necessary <br />open area for fire lanes. The provision of fire lanes will <br />further reduce the number of parking spaces. <br />-Another modification to the zoning code resulting from this <br />proposal is that off-street parking of 4 or more vehicles <br />be screened from adjacent public right-of-ways. The proposed <br />two foot berm and 5 Russian Olive trees do not and will not <br />adequately screen the parking area.
