The following is a list of the <br />modifications requested by the applicant for the condominium <br />building: <br />1) 4 story building; <br />2) Less than the required number of <br />3) Front yard parking; <br />4) Off-street parking within 15 feet <br />5) Lack of handicap parking spaces; <br />6) Parking spaces only 19 feet deep; <br />7) Rear yard building setback of 28 <br />B. Variance <br />parking spaces; <br />of a parking right-of-way; <br />and <br />feet, 30 feet is required. <br />In addition to the above modifications from the zoning code the <br />applicant is requesting a varinace to deviate from.the PRD <br />Section 11-350 standards. 1. that requires .a minimum setback of <br />the height the building or 25 feet, whichever is less, for all <br />property lines which form the perimeter of the entire plan of <br />the PRD. The applicant proposes a 10 foot side yard setback <br />on the east side. <br />The warrants for the consideration for a variance include undue <br />hardship, unique circumstance relating to specific property. <br />Staff contends that this application does not meet the warrants <br />for approving a variance. <br />The applicant started with a 17 acre site and subdivided the <br />property for specific uses. The property in question was sub- <br />divided in 1980 for a 4-story condominium building and now in <br />1981 the applicant designs a building that does not fit the site. <br />Not only is a setback variance requested but this application <br />contains at least 7 modifications to the zoning code. <br />Beyond the contention that there is no hardship nor unique. <br />circumstance this application is not consistent with Council <br />approved, PRD #27 (Resolution 2026) for the following two reasons: <br />1) That the resolution addresses providing more parking spaces <br />than the minimal number required by code. This application <br />does not provide even the number required by code; and <br />2) That the Council approved a 4-story building and that the <br />building height and,bulk would typically manadate greater <br />setbacks than those required by the code under standard <br />applications. Because of the 4 stories rather than the <br />typical 2 stories the setbacks should be greater not less <br />under a variance request. <br />Site & Buildinq Plans <br />The site and building plans include the aforementioned modifications <br />to the zoning code. Also, the building elevations do not provide <br />a height designation or type of exterior wall treatment. The plans <br />are not signed by a registered architect or engineer.
