Johnson <br />2599 Mississippi Street <br />(Generally located south of <br />Mississippi Street and west of <br />Silver Lake Road.) <br />B-3, General Business <br />17,568 Square Feet <br />3,000 Square Feet <br />3,000 Square Feet <br />6,000 Square Feet <br />.34 <br />Office <br />30 Spaces <br />28 (Alternative #1) <br />25 (Alternative' #2) <br />Floor plans-for both levels are <br />missing and application has not <br />been made with the Rice Creek <br />Watershed District. <br />The applicant is requesting a variance to have 2 or 5 less parking <br />spaces than is required. In considering a variance application the <br />warrants of undue hardship and unique circumstance relating to this <br />property must be present. <br />The applicant's letter (see attachment) states that the unique <br />circumstance is that the addition will not expand the number of users <br />of the facility and that only 10 spaces are being used at any given <br />time presently. <br />Staff's concern is that it is probably true that law offices and the <br />accountant office do not require an excessive number of parking spaces. <br />However, the building is an office building and the uses can change <br />to different types of offices that require more parking. Of the <br />zoning code parking formulas in the business districts the office <br />formula used for this application is the least restrictive of all <br />commercial uses. If for instance this building were sold to a <br />retail user the parking requirement for the site would almost double.
