December 14, 1982 <br />~:~.~ TION FOR VARIANCE AND SITE PLAN APPROVAL <br />VN-22 LP-136 AND LP-138, CITY OF NEW BRIGHTON <br />PURPOSE <br />To consider a request for a variance and site plan approval for Well <br />House #10 and site plan approval for Well House #11. <br />BACKGROUND <br />APPLICANT: City of New Brighton <br />LOCATION: 4Je11 #10 - South of Jones Lake <br />Wel l#ll - 7th Street NW & Hansen Park <br />ZONING: Well #10 - I-1, Light Industrial <br />Well #11 - R-1, Single Family Residential <br />PROPOSAL <br />1. Well #10 - To construct a building to house the well and iron <br />removal equipment. The reason for the variance request is that <br />the zoning code requires a 60 foot setback from residential <br />districts and the building is only 50 feet from the west. <br />property line. The unique circumstance is that the City has to <br />construct this new well in response to the water contamination <br />problem. The undue hardship facing the City is that the <br />Minnesota Health Department will only approve this location <br />because of State distance requirements from the water tower and <br />underground storm sewer pipes. To meet zoning code requirements <br />the City would be forced to select another site or purchase <br />additional property which would be an undue hardship. The impact <br />of the 10 foot variance request is lessened because the west <br />property line of the adjacent property consists of a row of <br />garage buildings for the apartment complex. The 10 foot variance <br />wi17 not have a negative visual impact nor create any safety <br />problems for adjoining residents. <br />2. Well #11 - To construct a structure off of 7th Street NW on City <br />owned property adjacent to Hansen Park to house Well #11 and the <br />iron removal equipment. The construction of this well and <br />structure is a part of the solution to the City's water <br />contamination problem. <br />RECOMMENDATION <br />To waive the reading and adopt the attached resolution recommending <br />approval of VN-225. <br />To recommend approval of LP-136 and LP-138 subject to the following <br />conditions: <br />1. That final plans be approved by Rice Creek Watershed District <br />and City Engineer; <br />2. That there is conformance with site and landscape plans. <br />~~ <br />an M.
