<br />~ <br /> <br />Council Meeting Minutes <br />January 27, 1987 <br /> <br />I Mattila responded this mistake occurred during the construction <br />process; the City Building official did not understand the <br />location of the easements during the initial inspections. <br /> <br />Mark Murlowski, Belair Builders, explained there was an error in <br />the arithmetic and was in no way the fault of the City Building <br />Official; originally the design was for a 26 foot wide home, which <br />was downsized to 24 feet and adjustments were made on the <br />setbacks; the 3 foot discrepancy was discovered during an as-built <br />survey on all the homes in the area. <br /> <br />Brandt asked if Belair had this kind of error before in the City <br />of New Brighton. <br /> <br />Murlowski responded no, not in the sixteen years of his <br />experience; this type of error entails some expense by the <br />contractor to correct; also Belair wishes to keep the goodwill of <br />their clients. <br /> <br />Benke asked if survey locations are normally checked at any point <br />during construction by the city or is this the responsibility of <br />the builder. <br /> <br />I <br /> <br />Mattila responded if the drainage easement is placed on'the <br />survey, the Building O~ficial would notice such a discrepancy; <br />however, if the drainage easement is not indicated on the survey <br />then the Building Official cannot be aware of it. <br /> <br />Benke asked if as a matter of procedure the Building Official <br />checks the plats and plans to insure the easements are recorded. <br /> <br />Mattila responded affirmatively; has no explanation on how this <br />easement slipped through without anyone noticing it. <br /> <br />Benke stated the easement line is being adjusted to clear the back <br />corner of the house; does this line continue into the parcel next <br />door; asked for clarification of the easement. <br /> <br />Murlowski responded affirmatively; it does jog back to the current <br />location. <br /> <br />As there were no further comments or questions by councilor <br />staff, and no one was present to be heard, Schmidt moved, seconded <br />by Williams, to CLOSE THE PUBLIC HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />I <br /> <br />Motion by Brandt, seconded by Schmidt to WAIVE THE READING AND <br />ADOPT THE RESOLUTION VACATING A pORTION OF THE SUBJECT UTILITY AND <br />DRAINAGE EASEMENT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />. <br /> <br />1; <br /> <br />1 <br /> <br />Page 3 <br />
