<br />. <br /> <br />., <br /> <br />, <br /> <br />. <br /> <br />l <br /> <br />\ <br /> <br />, <br /> <br />.,. ..' <br />.;/t' <br />, ~ <br /> <br />t <br /> <br />Council Meeting Minutes <br />January 27, 19B7 <br /> <br />I Mattila briefly outlined the staff report concerning a request for <br />a minor subdivision (1231 Long Lake Road). <br /> <br />Mattila pointed out the discrepancy in the old and new surveys on <br />the map. <br /> <br />Benke asked if the new survey corrects the north property line and <br />the acquired land on the south side. <br /> <br />Mattila answered affirmatively. <br /> <br />Benke asked if the property owners to the north and south are in <br />agreement this new survey line is the appropriate line. <br /> <br />Mattila answered the property owner to the south is in agreement; <br />the property owner to the north is concerned her parcel now is <br />losing 3 feet; however according the surveyor, all the lines are <br />off so her lot should remain the same width. <br /> <br />In response to Gunderman's inquiry regarding trees, shrubbery and <br />fences, Mattila stated everything would be off by about 3 feet <br />according to this survey. <br /> <br />I Benke stated there have been other lot splits in the area over the <br />past few years; is there a reason this particular one showed up in <br />error. <br /> <br />Proper recalled there was a similar discrepancy on Rice Creek Road <br />some years ago. <br /> <br />Benke asked what the legal obligation of the property owner is in <br />following up on any discrepancy discovered in a new survey. <br /> <br />Proper responded the only thing the City can do is accept the <br />survey performed by a registered land surveyor; the property owner <br />to the north can disagree and hire another surveyor; the owners <br />could then agree upon a line and come into to the City for a <br />combination redivision of the property. <br /> <br />Gunderman again expressed his concern about the ramifications; <br />questioned whether acting on this subdivision create further problems. <br /> <br />.. <br /> <br />t <br /> <br />l <br /> <br />Page 4 <br /> <br />Minor Subdivision <br />PL-153 <br />1231 Long Lake Rd <br />Report 87-31 <br />Resolution 87-14 <br />7:4B-7:56p.m. <br /> <br />Ma~tila answered a survey of the entire area would'be an alternative; j <br />a minor subdivision request normally requires only a certificate of <br />Survey of the parcel in question, which the applicant has done. <br /> <br />I <br /> <br />LeFevere suggested a notation be made on the files of the other parcels <br />on the block so if applications are made for building permits or variances <br />the City does not become involved in property disputes stemming from any <br />City action. <br /> <br />.. <br /> <br />'. <br /> <br />.~ <br />
