Motion by Leverkuhn, seconded by Baker, to waive the reading
and adopt the attached resolution except that items two and
three under Now Therefore Be It Resolved be amended as follows:
2. That the building was originally constructed
as a school and retains that character.
3. That the applicant has shown unique and un-
usual circumstances for the variance.
BE IT FURTHER RESOLVED that the application is and hereby recommended
for approval.
Commissioner Baker stated he also examined other churches in the
community and that Atonement Lutheran Church on Silver Lake Road
has an almost identical cross to the one proposed. Commissioner
Baker stated that Salem Baptist and Christ the King Church had
similar crosses which have established a pattern.
Commissioner Leverkuhn stated that the only reason the applicant is
in the present position is because the church was not originally
designed as a church and that the applicant should not be penalized
for this.
Chairman Williams stated that approving the applicant's variance
would not be setting a precident.
Vote on Motion
5 ayes - 0 Hayes Motion Carried
