RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />APRIL 5, 1984 <br />.RESOLUTION MAKING FINDINGS OF FACT DENYING VARINACE VN-231. <br />WHEREAS, an application for VN-231 has been made by <br />Remington Builders to allow less than the required front yard <br />setback; <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application for a variance VN-231 was filed <br />with the City on March 6, 1984. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on March 20, <br />1984, and all persons present at the hearing were given <br />an opportunity to be heard. <br />3. That such application was reviewed by the City Council <br />on April 10, 1984. <br />4. The written comments and analysis of the City Staff and <br />the Planning Commission minutes and recommendations <br />were considered. <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-231: j <br />1. <br />2. <br />3. <br />4. <br />That the property is zoned R-1, Single Family <br />Residential; <br />That the required front yard and side street yard <br />setbacks in R-1 zoning districts is 30 feet; <br />That there do exist building configurations that <br />would fit on the lot and reduce or eliminate the need <br />for a variance; <br />That although the lot is unusual the applicant has failed <br />to show that undue hardship would result if the variance ' <br />was not granted. <br />BE IT FURTHER RESOLVED, that the application for VN-231 is <br />and hereby denied. <br />Adopted this 10th day of April, 1984 <br />Gregory B.
