RESOLUT-ION N0. <br />STATE OF MINNES~ <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING VARIANCE REQUEST <br />VN-237, SIGN FOR TOM THUMB.' <br />WHEREAS, an application for a variance has been made. by <br />Tom.Thumb; and <br />WHEREAS, the procedural fiistory of the application is as <br />follows: <br />1. That an application fora variance VN-237 was filed <br />with the City on July ]7,'7984. <br />2. That the Planning Commission, pursuant to published <br />and mailed notices, held a public hearing on August <br />August 2l, 7984, a7l~person's present at the hearing <br />were given an opportunity to be heard. <br />3. That said request was considered by the Council on <br />August 28, 1984 and staff analysis and Planning <br />Commission minutes and recommendation were considered. <br />WHEREAS, the property is legally described as follows: <br />The North 100 feet of the south 271 feet of the <br />west 183 feet o.f the SW114 of the NE 1J4, subject <br />to road, of Section 31, Township 30, .Ramsey County, <br />Minnesota <br />NOW THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-237: <br />1. That the property is zoned B-2, Neighborhood Business <br />2. That there exist alternative signable areas that are <br />visible and on which a wall sign can be displayed in <br />total conformance with the City Zoning Code. <br />3. That there is an existing pylon sign identifying the <br />store. <br />~. That the applicant has failed to demonstrate unique <br />and unusual circumstances and undue hardship resulting <br />from denial of the variance. <br />BE IT FURTHER RESOLVED that the application VN-237 is and <br />hereby denied. <br />Adopted this day of August 7984. <br />ATTEST: <br />Gregory Harcus, Mayor <br />Henry 5inda, City Manager <br />argaret A.
