Nienaber, Building Official J~~~ <br />St1BJECT: VARIANCE APPROVAL -'.DECK <br />_:'1596 28TH AVENUE NW <br />It is my understanding .that the Planning. Commission at their meeting on <br />October 16, 1.984 recommended approval of.a variance of 2 feet for. a' <br />duck that was constructed at 1596 28th Avenue NW. It is further my' <br />understanding that they interpreted Section 4-580 of the New Brighton <br />City Code to allow decks to be within 2 feet of :all property lines. <br />It is my .opinion that a deck does not fall :into the similarfeatures <br />provision of Section 4-580(b). Steps and uncovered porches are used <br />as-entrance's into. dwellings and are not used for .recreational purposes <br />and are never screened from the street. However, decks are fore <br />recreational purposes and may. or may not be screened from the street. <br />If the Planning Commission's recommendation is allowed to stand it <br />would mean that a deck could be installed in the front yard to within <br />2 feet. of thepropertyline and be fully screened to whatever height <br />they desire. <br />_I am not oppossed to the Lawson's variance.- However if a variance's,to <br />be granted it should be granted for the entire encroachment into the <br />setbackand not just 2 feet. <br />mh <br />l <br />
