.. <br />RESOLUTION N0. <br />NEW BRIGHTON PLANNING COMMISSION <br />RESOLUTION MAKING FINDINGS OF'-FACT AND'REGOMMENDING APPROYAL'OF <br />VN-238, fora less thanrequired side street yard setback. <br />WHEREAS, an application fora variancehas been made by <br />John and Melanie Lawson; and <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. That an application fora variance was 'filed <br />with the City on September 28, 1984: <br />2. That the~Planning Commission, pursuant to <br />published~-and mailed notices, held a public <br />hearing on October ]6, 1984, all person's present <br />at the hearing were given an opportunity to be heard. <br />3: That the deck replaces an existing deck. <br />4. That since the deck was a replacement of an existing <br />deck the applicant .would have been permitted to repair <br />the existing deck up to 50 percent of its current value <br />without a permit from the City: <br />WHEREAS, the legal description of the property is as follows:) <br />Lot 1, Block 4, Oakwood Manor 'Terrace. <br />NOW THEREFORE BE IT-RESOLVED.BY THE Planning Commission that:'. <br />the following Findings of Fact are made in respect to_VN-238: <br />1 . That the property i s zoned R-1 , Si ng1 a Family Residential <br />2. That the required side street yard setback for the deck <br />is 2-feet under Section 4-580 (b) of the zoning code. <br />3. That the applicant is requesting a zero side street yard <br />setback. <br />4.
