VN-240
December 6, 19.84
Page 3'
Due to the urgent security problem expressed by the applicant we
allowed construction of-the fence to be'completed on the condition
a letter was drafted stating a variance would be applied for, and
if the variance was not granted the fence would be moved. (see .attached
letter). Since the fence is already up and in place I urge the Council
to visit the site.
As seen on the attached survey th.e.shape of the lot and location of
the building are somewhat unusual. The west property line along
Old Highway #8 is an "L" shape around an exi-sting tavern. The tavern
is indicated by the shaded area on the survey.. The building is set-
back 156 feet from the western most property line (116 feet from the
Old Highway #8 right-of-way). The front yard of the building contains
a large berm which obscures the view of much of the property from Old
Highway 8. The fence will extend 14.5 feet beyond. the front of the
building..
The construction of the fence is chain link with a barbed wire top.
The purpose of the fence is for security. The applicant's business
is vehicle repair, primarily trucks. Many of the vehicles must be
parked outside while they-are waiting for repairs or ready to be
picked up. The applicant has had problems with vehicle owners driving..
the repaired vehicles away during nighttime hours, thus not paying
for repairs. There have also been problems with truckers and other
patrons of "The Station" tavern driving through and parking on the
Roseville Diesel property behind the tavern, as well as beer cans and
people driving from the paved-yard on the south side of the building,
around the southwest corner of-the building, across the front yard of
Roseville Diesel to the driveway.
The driveway entrance to the site is north of the existing building.
There is a several foot grade change along the north property line
(the property to the north is higher). There is not enough room to
install a roll back gate between the north property line and the north
side of the building. Although swinging gates would fit in this area
the applicant has indicated that swinging gates would make it more
difficult to snowplow the drive and bl-ock existing building entrances
when the gates were open.
I have contacted Al Bauer, Fire Chief for his concerns. for the
fence and he has in turn discussed the situation with the applicant.
A fence around the entire building may create more property loss
beca-use of the time it will take to cut the chain 1-ock on the fence.
.The .applicant is aware of this. Al Bauer, would like the Council
to be aware that this type of fencing can cause problems and should
be discouraged as much. as possible..
