RESOLUTION N0. <br />STATE OF MINNESOTA <br />COUNTY OF R,AMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTfiON MAKING FINDINGS OF FACT AND APPROVING VN-240 for an <br />eight-foot fence in a front yard. <br />WHEREAS, an application for a variance has been made by <br />Roseville Diesel, Inc. <br />WHEREAS, the procedural history of the application is as <br />follows: <br />1. Comm ission minutes and recommendations were considered. <br />WHEREAS, the property is legally described as: <br />That part of the North 225 feet of the South 785 <br />feet of the Northwest Q of the Southeast 4 of Section <br />29, Township 30, Range 23, lying West of the land <br />.conveyed to the Minneapolis, St. Paul and Sault Ste. <br />Marie Railway Company in "53C" Deeds 135, except the <br />North 100 feet of the South 660 feet of the West 1.40 <br />feet of said Northwest 4 of Southeast 4 of Section 29, <br />Township 30, Range 23. <br />Subject to easements of record. <br />NOIrJ THEREFORE BE IT RESOLVED by the City Council that the <br />following Findings of Fact are made in respect to VN-240. <br />1. That the property is zoned I-1, Light Industrial. <br />2. That the existing building is setback 116 feet from <br />01d Highway 8. <br />3. That there is an existing berm which visually obscures <br />much of the building from Old Highway 8. <br />4. That the fence will be setback 101.5 feet from Old <br />Highway 8. <br />5. That the fence conforms to all aspects of the ordinance <br />except for height. <br />6. That the seven-foot cha.i n 1 ink fence with one-foot of <br />barbed wire in the front yard is necessary for security <br />of the property. <br />7. That the construction of the proposed fence is con-- <br />sistent with the purpose and intent of the fence <br />'~ regulations. <br />Adopted this 11th day of December, 1984. <br />Gregory B.
