This: language clearly provides for approval or rejection by the City Council. <br />of the City of New Brighton before becoming effective. <br />Under Minnesota Statutes, the City certainly has the authority to enter <br />into the Joint Powers Agreement as we11 as the County, so i-hat insofar as <br />developing .the plan, I seeno legal problems: <br />I have read the ..letter of .July 21, 1981 signed by Patricia Commers as it <br />refers to the reooarmended action plan for expediting .acquisition developirnnt <br />and maintenance and operation of Ir~ng Lake-Rush Lake Regional Park. I have <br />just receiveda copy of that document and so have not made a thorough analysis <br />of same. Hcxaev~er, upon reading the letter, it appears that most of the <br />ccximen~ in the letter are addressed to political issues as distinct from <br />legal issues.. It seems to me that the legal issues are addressed in this <br />letter but I-would point out that there is no legal requirement that there <br />be a vote on any of the issues as suggested in the letter of the Ir~ng Lake <br />Improvement Association. I am attei~ting to.get a copy of the County <br />Ordinance Building Parks so that an appropriate eonparison can be made betwoeen <br />that and the existing New Brighton Ordinance. <br />I am aware that the County on some other issues has maintained citizens' <br />advisory ooamiittees and it might be that the County would consider having <br />k~ a citizens' advisory committee established for this park as well as other <br />regional parks within the County.
