July 15, 1981 Park Board Minutes <br />Page 4 <br />Gunderman stated that originally he wanted to see the park <br />locally owned.and operated. After 11 years, many things have <br />changed. This is the best alternative. Residents are asking <br />questions that.we can't answer because we are not that far <br />along yet. Support joint powers agreement as presented to us <br />and get on to the next..:point. <br />Dahl asked at what point the land changes hands. <br />Anderson said about the time the joint powers agreement is signed. <br />The City Attorney will begin.legality research- Actual transfer <br />will take place in about a.year. Master plan will take from 2 to <br />4 months. At no time would transfer take place before the master <br />plan is approved by all three agencies. <br />Carlson asked the reason for not submitting the Statement of <br />Understanding to the Council. <br />Anderson said it is not necessary because we will be included in <br />the planning with Ramsey County. We wanted some commitment from <br />Ramsey County staff that they will permit us to have input into <br />the plan, so the Statement of Understanding was agreed to by <br />Ramsey County. We don't need the Council to approvO.content of <br />the plan because the Council has approval of the plan as its <br />final option. <br />Carlson said Ramsey County staff is agreeing to the Statement of <br />Understanding. <br />Anderson said yes. <br />Robert Polzak, 1693 14th Ave. N.W., attorney who is representing <br />the Long Lake Improvement Association stated he is upset and would <br />like to give the Park Board a five hour lecture. He has a number <br />of concerns with the Statement of Understanding and the joint <br />powers agreement. Frankly, he can't believe the lack of under- <br />standing with what you people plan to do. Plans to leave after <br />his lecture so that we won't be discussing the law.. Is here in <br />good faith and to raise issues for your concern. The homeowners <br />understand their rights. Putting you on notice for legal and <br />practical level of responsibility on your part so you know what <br />to be concerned about. We are dismayed, can't believe what you <br />have said. Can.'t believe you've had counsel, don't drive us to the <br />wall. The first document, Statement of Understanding, look at the <br />"whereas" provision. Want a joint powers agreement between Ramsey <br />County and New Brighton. You have to have legal advice. Anderson <br />said this is the only way. You better talk.to a lawyer for legal <br />advice. The master plan the City and County shall endeavor will <br />not let City have say of what goes into the plan. <br />Solberg told Polzak she thought he was going to talk about issues, <br />not legalities. <br />Polzak continued and said there is no language that says the County <br />will do the following things. It"s all meaningless.
