July 1, 1981 Park Board Minutes Page. 11 <br />Dahl asked what would happen if the County deviates from the <br />plan 10 years after it was drawn up. .How long is the master <br />plan in effect? <br />Anderson said the master plan could not be changed without the <br />three-party consent.. All parties have to agree. There is <br />no expiration date on master plan.. <br />Carlson asked that in 10 years from now if Ramsey County wants <br />to change after everything has been developed, is there a recourse? <br />Anderson again said that we still have to have all three approvals. <br />Schmidt said that it may be .good to have some kind of legal re- <br />course. Tt'S better to add. it if there is a default to have the <br />buy-out provision. It never hurts to negotiate the clause. <br />Carlson said that .the City Attorney should word the buy-back option <br />and if feasible, the figure of reimbursement to the City would be <br />at today's figure. <br />Carlson said he would like this renegotiated if there is another <br />joint powers agreement. It could go on for 100 years if'necessary, <br />Gunderman stated he wants to see the motion open ended. <br />Amendment by Carlson., seconded by Olson, that the Park Board requests <br />that the City Attorney be directed to draft the language for the <br />joint powers agreement that provides for the City to regain control <br />over the Park in the event. the County fails to perform its responsi- <br />bilities for providing a "base" level of service whether it is <br />through a lease by City to County with default termination provision, <br />or buy-back provision by City from County, or-some other legal form <br />to meet the intent for City .control over the park if the County <br />defaults. Amendment passed. <br />Van Hatten stated he was uncomfortable with the 1984 date. <br />Dahl said that is a time to renegotiate, it is not an end, it is <br />a check point. <br />Van Hatten said he would like to remove number 7. It says what <br />we do is null and void. <br />Anderson said that by law a-joint powers agreement must have an <br />expiration date, <br />Anderson said that both Ramsey County and Met Council want the <br />1984 date in for different reasons. Ramsey County wants to make <br />sure they have maintenance and operation money available. Met <br />Council has a 5 year policy plan and the 1984 date is the end of <br />the five years. It is not the intention of either party to <br />terminate. <br />
