~,K,ai6s. <br />Contingent upon°final approval of a .development master plan by the <br />Metropolitan Counci], County of RamseyR and City of New Brighton,- then,.... <br />Ramsey County will request the release of all programmed or escrowed <br />Metropolitan Council development funds for the Long Lake/Rush L4ke <br />Regional Park. <br />a^~°~ <br /> <br />3.4 <br />As detail. plans for each phase of development, improvements or ex- <br />pansion of facilities are prepared by the County, the City of New <br />Brighton and the Metropolitan Council will be given the opportunity <br />for review and .approval of same. <br />The County of Ramsey will proceed with the development for each phase <br />using Metropolitan Council development. funds, immediately folipwing <br />approval of detailed plans, recognizing constraints such as biding <br />requirements, the weather, and other reasonable delays. <br />Operation and Maintenance <br />4.1 The County of Ramsey'in its capacity of "implementing agency" to the <br />Metropolitan Council and as ultimate owner of Long Lake/Rush fake <br />Regional Park will retain full responsibility for the operation and <br />maintenance of the park in accordance with County ordinances,'policies <br />and procedures. <br />4.2 The County of Ramsey agrees not to program the facility for use in- <br />tensities beyond the capaci-ties specified in the original o r modified <br />design approvals granted in 3.3. <br />4.3 In the interim period while the issues of additional non-county funding <br />sources for the operation and maintenance of Metropolitan Regional <br />Parks is publically debated and resolYed the County of Ramsey will <br />provide operation and maintenance funding to a base level of services, <br />consistent with the approved master plan, which it deems appropriate <br />and within its limited resources. - <br />4.4 The County shall retain the option to Contract with the City of New <br />Brighton and/or any other responsible agency, to provide operations <br />and/or maintenance service within all or any portion of long Lake/ <br />Rush Lake Regional Parka <br />a. Within this context, by mutua) agreement between the <br />City and the County, the City of New Brighton may <br />participate in the funding of operations and mainten- <br />ance where the level of regional park `services the <br />parties desire to provide is in excess of that which <br />the County feels able to provide. <br />4:5 The parties understand and agree that this interim commitment to oper- <br />ation and maintenance of Long Lake/Rush Lake Regional Park does not <br />in any way change. or alter the County's publically stated position on <br />the need for "additional non-county sources of funding" for the oper- <br />ation and maintenance of regional parks and park reserves within the <br />County. <br />Rev. 10-28-80 <br />EM: jh -2- <br />
