REVISED April 28, 1980 JOINT POWERS AGREEMENT REGARDING DEVELOPMENT AND USE OF INDEPENDENT SCHOOL DISTRICT N0. .621 OUTSIDE FACILITIES AT HIGHVIEW MIDDLE SCHOOL THIS AGREEMENT, made this _ day of__ ____~, 1980 between the CITY OF NEW BRIGHTON,hereinafter referred to as the "CITY" and IPJD~PENDEPJT SCHOOL DIS- TRICT N0. 621, hereinafter referred to as the "SCHOOL DISTRICT" WITNESSETH: WHEREAS, the School District owns and operates Highview Middle School, the premises of which include certain outside facilities, said school site delineated in red on the map attached hereto and made a part here of Exhibit A, and WHEREAS, it is the mutual desire of the School District and the City to cooperate for the purposes of permitting said outside facilities to be used for' the education and recreation activity programs of the School District and the City, and WHEREAS, the School District and the City desires to upgrade and maintain • the HighviewP1iddle School outside facilities to permit utilization, not only by the pupils of the School District, but also by the citizens of the School Dis- trict and of the City, NOW, THEREFORE, BE IT RESOLVED, that in consideration of the foregoing re- citals and mutual covenants and promises herein set forth, it is hereby agreed 'by and between the School District and the City as follows: 1. INSTALLATION, UPGRADING, MAINTENANCE AND REPAIR The City agrees to participate in the maintenance and development of the outside facilities at IiighviewAlidd]e School. The City's contributions will consist of maintenance, in-kind services and/or capital equipment for a 3 year total not to exceed $15,000 for the years 1980, 1981 and 1982, unless this agreement has been previously terminated pursuant to the provisions of paragraph 5. A specific contribution agreement will be developed mutually by both parties for the year 1980 within a reasonable time after the approval of this Joint Powers Agreement. Specific contribution agreements for the years 1981 and 1982 will be developed mutually by both parties • before March 15 in each of those respective years.
