Zylla, City Manager <br />RE: Highview Joint Powers Agreement <br />In reviewing the latest information submitted by the <br />school district personnel and by you, it is my conclusion <br />that we ought to consider either one of two alternatives: <br />1. That we not enter into a Joint Powers Agreement but <br />continue as we have in the past to work cooperatively <br />with the school district to assist t}iem in certain <br />maintenance efforts when it is feasible to do so; or, <br />2. The City ought to consider entering into the Joint <br />Powers Agreement simply to formalize the spirit of <br />cooperation that exists and to provide the City with <br />the authority to perform work on school district <br />facilities, indemnify each other, and to identify <br />the school district's authorization to the City to <br />use school facilities. <br />Since the City is not intending to mow school facilities, <br />I see little of substance added by the City through the <br />standard of maintenance on school grounds by our formal <br />participation and funding of school facilities maintenance. <br />Clearly there may be times when it is to the advantage <br />of the taxpayer that joint cooperative efforts be under- <br />taken. In these situations, both parties ought to attempt <br />to facilitate the other in order to provide the services. <br />Beyond that, I see as the only reason that the City should <br />participate by the expenditure of resources, either in-kind <br />services or cash, as the need to improve the standards of <br />operation beyond some standard which should be provided <br />by the school district. I fail to see that the school <br />district's standards are unacceptable or unattainable, <br />and I question whether the City is prepared to commit to <br />a modified standard even if the current standard is un- <br />acceptable or unattainable. <br />I'i1 be interested in the Park Board's reaction to your <br />reports. <br />DSZ:jd <br />
