Zylla, City Manager RE: Highview Joint Powers Agreement In reviewing the latest information submitted by the school district personnel and by you, it is my conclusion that we ought to consider either one of two alternatives: 1. That we not enter into a Joint Powers Agreement but continue as we have in the past to work cooperatively with the school district to assist t}iem in certain maintenance efforts when it is feasible to do so; or, 2. The City ought to consider entering into the Joint Powers Agreement simply to formalize the spirit of cooperation that exists and to provide the City with the authority to perform work on school district facilities, indemnify each other, and to identify the school district's authorization to the City to use school facilities. Since the City is not intending to mow school facilities, I see little of substance added by the City through the standard of maintenance on school grounds by our formal participation and funding of school facilities maintenance. Clearly there may be times when it is to the advantage of the taxpayer that joint cooperative efforts be under- taken. In these situations, both parties ought to attempt to facilitate the other in order to provide the services. Beyond that, I see as the only reason that the City should participate by the expenditure of resources, either in-kind services or cash, as the need to improve the standards of operation beyond some standard which should be provided by the school district. I fail to see that the school district's standards are unacceptable or unattainable, and I question whether the City is prepared to commit to a modified standard even if the current standard is un- acceptable or unattainable.
