~~ <br />;~~: <br />~ ~ - <br />i- r ~ <br />,, <br />RESOLUTION NO `'; <br />.STATE OF MINNESOTA <br />f'0f1f~TY OF RAMSEY <br />-CITY OF NEW BRIGHTON <br />RESOLUTION fiAKING FINDItJGS OF FACT .AND RECOMMENDING APPROVAL OF' <br />APPLICATION- FOR A PRELIfiINARY PLAfJNED RESIDENTI';9L DEVELOP1~1Ei~T, <br />PRD #30 <br />WHEREAS, An application for a preliminary Planned <br />Residential Development, PRD #30 has been made by J.A. <br />Cadwallader to construct townhouses and convert an existing <br />building into condominium units at a site generally located <br />north of Silver Lane 'and west of Oakwood Drive;-..and <br />WHEREAS, The procedural history of the. application is as <br />.follows: <br />1. That an application fora preliminary Planned <br />Residential De'vel'opment, PRD #30 with the City <br />'' s on November 13, 1979. <br />2. That the Board of Review heard and reviewed <br />the application at its regular meetings on <br />November 20, 1979, December 18, 1979 anal <br />January. 15, 1980. <br />3. The written comments and analysis of the City. <br />Planner and all person's statements made at the <br />Board of Review meeting were considered. <br />NOW THEREFORE BE IT RESOLVED by the Board of Review that <br />~ the following Findings of Fact are made in respect to PRD #30: <br />1. That the proposed development is consistent with <br />the proposed Comprehensive Plan; and <br />2. That theproposed development would not be <br />detrimentalto public health, safety, morals <br />andgeneral welfare of the surrounding area; <br />and <br />3. That the proposal is consistent with..the stated <br />purposes of the PRD ordinance as it makes the <br />..most efficient use of land and open space. <br />• ;;; <br />BE ITfFURTHER RESOLVED, That the application for the <br />preliminary PRD #30 is hereby recommended forapprova7 subject <br />to the following conditions: <br />i. .That all grading, drainage and utilities be <br />subject to approval of the City Engineer and <br />Rice Creek hJatershed District; and <br />2. That all fire and emergency ]apes, sprinkling <br />connections., and emergency access shall be <br />subject to the approval of the fire department, <br />and <br />.That the Council consider establishing the <br />`policy 'that the. park property be dedicated <br />to the City in the form. of deeding the <br />property to the City. That in lieu of a <br />deed transfer of the property that appropriate <br />legal agreements be concluded between the City <br />and apple-ant regarding use of the..park <br />focilities:and property; and <br />,4- That the proposed park be at least 5 acres in r <br />size; `and <br />That there be at least 300 feet of: access to <br />the parka off of Oakwood Drive, preferably that <br />there be no further construction along <br />Oakwood to~extend further to~the..north than <br />the northeast boundary of the existing building; <br />and <br />
