WHf REAS, The CITY and COUNTY are.. each separately and the two of them jointly are desireous that the entire Long Lake-Rush Lake Metro- politan Regional Park be developed., maintained, progra tuned and operated in a coordinated and efficient manner as a single recreational resource and Regional Park Site, NOW LEGAL THEREFORE THE PARTIES AGREE. THAT; BASIS: 1. Pursuant to the authority conveyed by Minnesota Statutes Annototed 459.01 (Joint Powers Act), the Long Lake-Rush Lake Regional Park shall be developed, maintained, programmed and operated in a coordinated and efficient manner as a single recreational resource and Regional Park Site, for the benefit of their. respective citizens and the public generally,. as follows: RELATION TO METRO. a. The COUNTY shall continue to act as the local implementing COUNCIL COST SHARING: MAINTENANCE: agency to the Twin Cities Area Metropolitan Council, - .pursuant to Laws of Minnesota 1973, Chapter 563 as amended (Metro Regional Parks Act) and contracts drawn pursuant thereto, for all Metropolitan Council funded development of Long Lake-Rush Lake Regional Park. b. That programming, maintenance and operation of Long Lake- Rush Lake Regional Park shall be shared by the. respective parties as hereinafter set out below; (1) All defined costs of programming, maintenance and and operations shall be shared on the basis of a population service area density and distribution formula, allocating 75~ thereof to the COUNTY and the remaining 25~ to the CITY.` ~ ~ " (2) Authority and responsibility for the planning and performance of maintenance within the entire. Long Lake-Rush Lake Regional Park Site shall be allocated as hereinafter set out below; (a) The .CITY will perform all turf maintenance,.` litter pick-up, sweeping of paved areas, complete maintenance of the beach, provision of police and fire protection services, grooming of recreation trails, snow plowing and removal as required.
