<br />i <br />WHEREAS, The CITY and COUNTY are .each separately and the two of <br />i <br />ahem jointly are desireous that the entire Long Lake-.Rush Lake Metro- <br />politan Regional Park be developed, maintained, programmed and operated <br />in a coordinated and efficient manner as a single recreational resource <br />and Regional Park Site, NOW <br />LEGAL THEREFORE THE PARTIES AGREE THAT; <br />BASIS: ~ <br />1. Pursuant. to the authority conveyed by .Minnesota Statutes Annototed <br />~,;~~ ~ ~ 459.01 (Joint Powers Act)., ,the Long Lake-Rush Lake Regional <br />~1~ <br />~,~ Park shall be developed, maintained, programmed and operated <br />in a coordinated and efficient manner as a single recreational <br />resource and Regional Park Site, for the benefit of their <br />respective citizens and the public generally, as follows: <br />RELATION TO METRO , a. The COUNTY. shall continue to act as the local implementing <br />COUNCIL <br />agency to the Twin Cities Area Metropolitan Council, <br />~ pursuant to Laws of Minnesota 1973, Chapter 563 as .amended <br />(Metre Regional Parks Act) and contracts drawn pursuant <br />thereto, for all Metropolitan Council funded development <br />e1''~ <br />' of Long Lake-Rush Lake Regional Park, <br />G <br />b. That programming, maintenance and operation of Long Lake- <br />Rush Lake Regional Park shall be shared by the respective <br />parties as hereinafter set out below; <br />COST SHARING: (1) All defined costs of programming, maintenance and <br />and operations shall be shared on the basis of a <br />-'° <br />„~/ ,may population service area density and distwibution <br />,t.~' ~ ~ r~~, ~"°formula, allocating 75% thereof to the COUNTY and <br />G~'" ` <br />p~ the remaining 25% to the CITY. <br />/~ ,~ ;, <br />MAINTENANCE: (2) Authority and responsibility for the planning and <br />performance of maintenance within the entire Long. <br />Lake-Rush Lake .Regional Park Site shall be allocated <br />as hereinafter set out below; ' <br />(8) The CITY will perform all turf maintenance, <br />.~ <br />' litter pick-up, sweeping of paned areas, complete <br />~,.,~c maintenance of the beachs~~rovfsion of dice <br />aJCO" and fire protection. services,.. grooming of recreation- <br />trails, snow plowing and removal as required. <br />(2) ~ <br />
