<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />December 9, 1986 <br /> <br />Council Business, continued <br /> <br />Benke stated if we apprehend persons who are on the grounds and <br />there is a problem, there should be grounds for an officer to <br />take some action; would be supportive of having staff confer <br />with School District staff to consider this issue further, not <br />knowing precisely what will become of that (state law may need to <br />be changed, may need a local ordinance change). <br /> <br />Williams asked if it is now against a city ordinance or a state <br />law to deface public property; Kelley responded affirmatively. <br /> <br />Schmidt stated his concern is that police officers cannot look <br />into the eyes of the suspect who mayor may not be a perpetrator, <br />he may simply be there for the sole purpose of enjoying what is a <br />public park and public park property. Schmidt noted that in the <br />summer time and on weekends, children under 16 are not actually <br />in the house at 9:00 or 9:30 p.m. and would probably want to be <br />in a park; and asked what the curfew hours are in New Brighton. <br /> <br />Kelley believed the current curfew hours for fourteen and fifteen <br />year olds is about 10:00 p.m.; and Midnight for 16 and 17 year <br />olds and noted there were exceptions. <br /> <br />Schmidt asked if you don't catch them and enforce vandalism, <br />the alternative is to enforce a curfew; that means running kids <br />off the street and believes that is really more of a home <br />environment and desirability in terms of controlling what time <br />kids come home. <br /> <br />Brandt stated another alternative might be to look at a trespass- <br />ing ordinance related to a certain time period which would give the <br />police something to use to remove persons who are conceivably <br />thinking of doing something illegal. Schmidt stated schools can <br />tell us what would be an appropriate time for the trespassing to <br />go into effect. <br /> <br />Benke, recognizing it will be difficult to write constitutionally <br />sound legislation, again suggested staff work with the school <br />district to find a solution. <br /> <br />Motion by Brandt, seconded by Williams, to ASK STAFF TO CONFER <br />WITH THE SCHOOL DISTRICT OFFICIALS REGARDING TRESPASSING AND <br />VANDALISM ON SCHOOL PROPERTY. <br /> <br />Brandt noted the Park Board minutes reflected a discussion of <br />glass containers in parks and asked about the probability of <br />banishing glass containers from the parks; Anderson responded <br />that this past Fall the City of Hopkins adopted a ban on all glass <br />containers in the park system and he will check with them in the <br />Fall of 1987 to see if the ban had any impact. If there has been <br />a positive impact in Hopkins, Anderson will have the item on a <br />Park Board agenda for a recommendation to council. In the mean- <br />time, Anderson will request ball teams to bring cans to the games <br />rather than glass. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Page Seven <br />
