<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 10, 1986 <br /> <br />Council Business, continued <br /> <br />Proper had nothing to add to the staff report concerning access <br />agreements for monitoring wells. <br /> <br />Motion by Williams, seconded by Gunderman, to APPROVE THE <br />EXECUTION OF THE ACCESS AGREEMENTS BETWEEN HONEYWELL, INC. AND <br />THE CITY OF NEW BRIGHTON FOR MONITORING WELLS AT TOTEM PARK AND <br />PIKE LAKE CIRCLE. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Williams explained he had asked that the Liquor License Renewal <br />for Robert Lee Restaurant be removed from the Consent Agenda <br />because council had previously received correspondence from a <br />citizen indicating that Robert Lee's had not adequately complied <br />with the requirement for landscaping and the citizen had asked <br />council to withhold approval of the liquor license until those <br />items were accomplished. Williams requested the status of land- <br />scaping before voting on the item. <br /> <br />Locke stated an October 24, 1986, letter to Mr. Lee stated the <br />sod needed to be replaced by November 3, 1986; since receipt of <br />the letter, Mr. Lee ordered, received, and replaced a good deal <br />of the sod along the citizen's side of the lot. Locke continued <br />that some of the sod that was to be replaced along Robin Lane and <br />Palmer Drive had not yet been completed; and clearly, due to the <br />weather, it is not possible to lay the balance of the sod. <br /> <br />In response to Benke's question, Krueger noted that the area <br />along the property line had been well roto-tilled, but not the <br />area along Robin Lane. <br /> <br />Benke asked, given the nature of this ongoing difficulty, if it <br />would be appropriate to give a shorter time-period on this <br />license; LeFevere asked if there were other things on the site <br />plan that had not been done, Krueger responded negatively. <br /> <br />LeFevere stated if council withheld the liquor license because of <br />sod dying, it could have more serious problems than in enforcing <br />the site plan requirements; however, if they had not substantially <br />complied with the site plan, that could possibly be sufficient <br />grounds to deny the license. <br /> <br />Schmidt stated there has been some attempt to comply with the <br />site requirements, albeit it's been extremely late in terms of <br />the season, and there is no question the liquor license is the <br />ultimate leverage the city has over this particular applicant in <br />terms of being able to operate their business. Schmidt believes <br />it would be an extreme measure to not grant the liquor license, <br />even a temporary license, under these circumstances and feels the <br />appropriate measure would be to approve the liquor license and <br />then, through staff, indicate to Lee the extreme disfavor with <br />which the application has come under scrutiny by the council <br />because of failure to comply with landscaping requirements and <br />complaints by residents of the city. <br /> <br />Page Eleven <br /> <br />Access Agreements <br /> <br />Report 86-280 <br />
