.'...a _ ~ l JOINT POWERS AGREEMENT RELATING TO MAINTENANCE AND OPERATION OF LONG LAKE/RUSH LAKE REGIONAL PARK This agreement is made this 1 1 th day of May 198 2 between the County of Ramsey, State of Minnesota (County and City of New Brighton, County of Ramsey, State of Minnesota (City). This agreement is entered into pursuant to Minnesota Statutes Section 471.59 (1980). Whereas, portions of Long Lake/Rush Lake Regional Park are currently owned by the County, and other pardons are are currently owned by the City, and Whereas, both parties recognize the regianal significance of the long Lake/ Rush Lake parks, and. Whereas, the County has been designated "implementing agency" to the Metropolitan Council for Long Lake/Rush Lake Regional Park, and Whereas, the County and City are engaged in negotiations to rectify the problems created by dual ownership of Long Lake/Rush Lake Regional Park, and Whereas., both parties recognize that the uncertainty of funding of main- tenance and operation costs of the regional park has been an impediment to these negotiations and also to development of the park, The County and City hereby enter into this agreement 'regarding operation and maintenance costs for the purposes of expediting the development of Long Lake/Rush Lake Regional Park and easing the problems crested by dual ownership of the park, and hereby agree as follows: 1. The City shall, at its sole expense, provide the maintenance and operation services listed below: a. The city shall provide police services .and the attendant attorney services necessary for prosecution of misdemeanors for the entire Long Lake~Rush Lake Regional Park. b. The City shall provide fire protection services for the entire Long Lake/Rush Lake Regional Park. c. The City shall continue to conduct a public beach operation on Long Lake and be wholly responsible therefore. The beach operation includes, but is not limited to, maintenance of the beach area, provision of lifeguards, and operation of concession stands or clubhouse facilities, if any. Any receipts obtained by the City for such concession stands or clubhouse facilities may be retained by the City. d. The City shall operate and maintain the areas designated for boat launching to include both motorized and non-motorized boat launch areas.
