Anders~d~ctor of Parks and Recreation Re: Long Lake Park Update There is currently action on three fronts, the Environmental Quality Board hearing, the request for a temporary restraining order by the LLIA and PCA's request to clean up the petroleum residuals on the site. 1) E.Q.B./E.I.S The hearing examiner has recommended that the city/.county be required to prepare an environmental impact statement. In very general terms the hearing examiner reasoned that almost any introduction of people into the site will have enough impact to warrant an E.I.S. He seemed to accept almost all of the .testimony presented by the witnesses for LLSA and reject testimony presented by the city and county. The chief hearing examiner and the E.Q.B staff have an opportunity to review the hearing examiner's findings. Since there has never been an E.I.S. required for a park development in Minnesota and since the examiner made rsome incorrect assumptions in his findings, we feet that there is a good possibility of either the E.Q.B. staff or the Chief Hearing Examiner disagreeing with his findings. and recommendation. The E.2.B. will then consider the various findings and recommendations in addition to state- ments of support and rebuttal from the attorney's involved. The E.Q.B. will render its decision in late October or November. 2) Temporary Restraining Order The LLIA has petitioned for a temporary restraining order to prevent the city from selling the land to the county and to prevent any development of the land prior to com- pletion of an E.I.S. (Under E.Q.B. rules the city/county could proceed with development during the E.I.S. process). • Judge Otis Godfrey heard the matter on Thursday, September 30, 1982.. He has at least four options.
