Anders~d~ctor of Parks and Recreation <br />Re: Long Lake Park Update <br />There is currently action on three fronts, the Environmental <br />Quality Board hearing, the request for a temporary restraining <br />order by the LLIA and PCA's request to clean up the petroleum <br />residuals on the site. <br />1) E.Q.B./E.I.S <br /> <br />The hearing examiner has recommended that the city/.county <br />be required to prepare an environmental impact statement. <br />In very general terms the hearing examiner reasoned that <br />almost any introduction of people into the site will have <br />enough impact to warrant an E.I.S. He seemed to accept <br />almost all of the .testimony presented by the witnesses <br />for LLSA and reject testimony presented by the city and <br />county. <br />The chief hearing examiner and the E.Q.B staff have an <br />opportunity to review the hearing examiner's findings. <br />Since there has never been an E.I.S. required for a park <br />development in Minnesota and since the examiner made <br />rsome incorrect assumptions in his findings, we feet that <br />there is a good possibility of either the E.Q.B. staff <br />or the Chief Hearing Examiner disagreeing with his findings. <br />and recommendation. The E.2.B. will then consider the <br />various findings and recommendations in addition to state- <br />ments of support and rebuttal from the attorney's involved. <br />The E.Q.B. will render its decision in late October or <br />November. <br />2) Temporary Restraining Order <br />The LLIA has petitioned for a temporary restraining order <br />to prevent the city from selling the land to the county <br />and to prevent any development of the land prior to com- <br />pletion of an E.I.S. (Under E.Q.B. rules the city/county <br />could proceed with development during the E.I.S. process). <br />• Judge Otis Godfrey heard the matter on Thursday, September <br />30, 1982.. He has at least four options. (See next page) <br />
