R <br />s ., <br />-2- <br />Sec. 19-35. <br />The Director of Parks and Retreat-ion, Chief of Police, or the <br />City .Manager may close the lake surface to all recreational use by <br />posting notice or the Order .upon determining the existence of con- <br />ditiens which constitute a danger to persons or property. <br />F:ROVTDED that the lake shall not be closed for more than five(5) <br />days without the approval of both the Council and. the Commissioner <br />of 'the Minnesota Department of Natural Resources. In any. case, the <br />Council and the Commissioner of the Minnesota Department of Natural <br />Resources should be notified as soon as practicable during this <br />five-day period. <br />Sec. 19-36. <br />The provisions of Minnesota Statutes Chapter 361 and the <br />Minhsota Department of Natural Resources Boat and Water Safety <br />Ru~:es are hereby adopted and incorporated herein by reference and <br />made a part of this ordinance. <br />Sec. 19-3'7. Enforcement. <br />Officers of the New Brighton Police Department and the Ramsey <br />County Sheriff's Department shall be authorized and. entitled to <br />enforce the provisions of this ordinance. <br />Sec. 19-38. Penalties.. <br />Any. person who shall violate any provision of this ordinance <br />shal:i be guilty of a misdemeanor. <br />Se~~b 19-39. Exemptions. <br />Boats utilized by authorized resource management, emergency <br />ani~ enforcement personnel when acting in the performance of their <br />assigned duties shall be exempt from the provisions of this ordinance. <br />-Sec. 19-40 <br />Temporary exemptions from this ordinance may be obtained through <br />a permit .issued by the City Council for special events, txatals.or <br />races. <br />Sec.. 19-41. <br />This Ordinance shall take effect after its adoption and publica- <br />tiolx except Sec. 19.31 c and d which shall take effect upon the official <br />opening of the Long Lake Regional Park power boat launch. <br />ATTEST: <br />Mayor <br />John R.
