R s ., -2- Sec. 19-35. The Director of Parks and Retreat-ion, Chief of Police, or the City .Manager may close the lake surface to all recreational use by posting notice or the Order .upon determining the existence of con- ditiens which constitute a danger to persons or property. F:ROVTDED that the lake shall not be closed for more than five(5) days without the approval of both the Council and. the Commissioner of 'the Minnesota Department of Natural Resources. In any. case, the Council and the Commissioner of the Minnesota Department of Natural Resources should be notified as soon as practicable during this five-day period. Sec. 19-36. The provisions of Minnesota Statutes Chapter 361 and the Minhsota Department of Natural Resources Boat and Water Safety Ru~:es are hereby adopted and incorporated herein by reference and made a part of this ordinance. Sec. 19-3'7. Enforcement. Officers of the New Brighton Police Department and the Ramsey County Sheriff's Department shall be authorized and. entitled to enforce the provisions of this ordinance. Sec. 19-38. Penalties.. Any. person who shall violate any provision of this ordinance shal:i be guilty of a misdemeanor. Se~~b 19-39. Exemptions. Boats utilized by authorized resource management, emergency ani~ enforcement personnel when acting in the performance of their assigned duties shall be exempt from the provisions of this ordinance. -Sec. 19-40 Temporary exemptions from this ordinance may be obtained through a permit .issued by the City Council for special events, txatals.or races. Sec.. 19-41. This Ordinance shall take effect after its adoption and publica- tiolx except Sec. 19.31 c and d which shall take effect upon the official opening of the Long Lake Regional Park power boat launch.
