3. The proposed master plan names New Brighton as the <br />unit of government responsible for operation and <br />maintenance of the boat launches and fishing area. <br />This was included as a concession to lake residents' <br />concerns regarding proper "control" over these <br />facilities. If the Council wishes to have that. <br />control, the Joint Powers Agreement should be <br />amended to be consistent with page X - 2 & X - 3 <br />of the proposed master pawn... <br />4. .Attached is information from the Minnesota Department: <br />of Energy, Planning and Development regarding pro- <br />cedures for alternative uses of Lawcon funded..property. <br />Item #3 was interpreted to me ws requiring that the <br />north and west. shores of Long Lake would have to <br />be`condemned for park purposes to satisfy this re- <br />quirement. Even if it were possible to secure approval, <br />the process is long and difficult with little. chance of <br />success. <br />5. The most. recent recommendation from .the. Long. Lake Improve- <br />ment Association lists four objections to the proposed <br />master plan. The concerns expressed in 1) and 2) were <br />carefully addressed in-the planning process, however it <br />is obvious that the Association is not satisfied. St <br />is the opinion of staff and the Park Board that a good. <br />faith effort has been made to protect .the interests of <br />lakeshore owners and to provide a high quality recrea- <br />tional facility. Item 3) refers to 30 boats. The plan <br />calls for 20 "powered " boats; 5 of these are high speed <br />powered boats. The Park Board recommends 15 powered <br />boats, 5 of .those to be high speed power boats, -Item 4) - <br />the parking lot is .designed for 150 ears, the Park Board <br />recommended 100 cars-.with an .estimated us by 200-500 <br />persons. <br />There has .been concern expressed by Ramsey County-staff concerning <br />the Park Board's recommendation regarding the termination date of <br />the Joint Powers Agreement.. Don Lais and I have been working with <br />staff from the County Attorney Office in an attempt to formulate <br />acceptable `language. Suggested wording of #7 (Joint_Poti?ers Agree- <br />ment) is as follows: <br />This agreement shall terminate on December 31, 2000, <br />unless the agreement is revised or terminated upon <br />terms mutually agreeable to the parties. The parties <br />expressly agree that any disputes arising hereunder <br />that are not satisfactorly resolved,shall,_ upon appli- <br />cation of one of the parties hereto be submitted to <br />an arbitrator who will have full authority to resolve <br />the dispute. The parties expressly agree that transfer <br />of fee title to Long Lake Park from the City to the County <br />prior to the termination date of this agreement shall not <br />accelerate the date of termination. <br />attachment <br />
